Sold car privately, buyer wants me to pay for fixing it after couple of days later.

  • Having seen this contract for the benefit of the thread, I would advise anyone selling a car refrains from signing anything with the words "contract" upon it.

    It may look generic but it contains a clause stating "is roadworthy".
    Now as Roadworthy is a subjective description that could be argued as a "catch all clause", an experts opinion the car needs repairs could be argued it is "un roadworthy"
    Signing such a contract is not in the sellers best interests and could leave you wide open to a legal claim.

    Surely, the wording on an MOT would see off any claim under the above. The MOT stipulates that the condition of the car is only as such at the time the car passed its MOT. One day later and the car won't be in the same condition.

  • I received a letter today from the person who bought it. This is an oryginal letter from his mechanic. Its from 17th December, day after he bought the car. It says:

    "After Inspecting your car for the noise in 5th gear we found that this is probably due to oil leak from the gearbox. The leak is coming from the selector shaft detent plunger which would help hold a selector in place of any selected gear. We have refilled the gearbox with oil and tightened the plunger. This however has not resolved the problem, the noise is still eveident but also when 5th gear is selected it will jump out of gear making the car dangerous to drive as it may happen at any time. To replace the gearbox and possibly a clutch it would be around 2560.00 all inclusive. The price is using genuine ford parts. A second hand gearbox would be much less at around 1200 all inclusive, subject to availability."

    Like I said before, the noise on the 5th gear was really hardly hearable, it completely didnt affect the driving, also when you were listened to the radio, you couldn't hear anything.
    Now gear jumps out as letter stated.
    I didnt know nothing about any leaks, there was no any stains under the car. When the buyer was testing the car he also didn't worry to much about that noise, he noticed that, but he was more concentrated or other things about the car.
    And he was happy with it and with smile decided to buy it.

    It will be stressful Christmas for me.

    Ignore him. He is attempting to bully you in to paying his repair bill.

    What's to say that inbetween buying the car and getting it home, he didn't drive it like a boy-racer, dropping the clutch and swift-changing through the gears.

    If the muppet does do Court, you will know as you will receive an official notice from Northampton CC and at this point you can file a defense of
    'Car was a private sale. Buyer took the car on an extended test drive and had no concerns regarding the noise from the gearbox when in 5th gear.
    Buyer was happy to sign a document to state he was happy with the car and would not wish to claim for any repairs'.

    Until/if this happens, relax. Do not even give the whole thing even a passing thought.

    Mine was a bit of paper with 'sold as seen'
    Either being too clever, or a home trader trying to hide behind paperwork?
    A small claims court should see the op off very quickly.
    (And hopefully the buyer will put in a call to the taxman as well)

    Buyer brought the contract with him, and asked me to sign it. Also this was 'private sale contract'. I wanted to paste it here to show you how it looks like, but i can't as a newbie.

    A contract is just like us private sellers used to use but then it was just a bill of sale, now you need to have the time and date in case dopey buyer gets a speeding ticket or worse.

    If you had you'd see it seems the OP is the one in the right not the buyer and no need to call the taxman either.
    Remember the saying: if it looks too good to be true it almost certainly is.

    Why did you sign it?

    I would have told him to sod off.

    I suspect he has done this before many times and may actually make a nice sum annually doing it.

    He probably sells the cars on straight away for a small profit then hopes he can bully sellers into giving him some money.

    The info in his mechanics letter sounds more than a bit iffy.

    Ask him for an AA or RAC Inspection.

    He might be stupid enough to pay for one.

    If you ever sell a car again then don't sign something brought by the buyer.

    Ever.
