Can a mobile phone contract be broken when nothing has been signed? My contract was renewed via the phone and was just an agreement.
Had a contract with T mobile (EE) for many years as I have always been happy with it.
Every time my contract was for renewal they contacted me.
I wasn't a mobile phone enthusiast and always bought my own basic phone. Last time they contacted me they tempted me by offering a phone for just a few pounds extra. All my friends and family members have these smart phones and when T mobile said they are offering a Samsung galaxy I agreed to a two year term. The phone arrived which was a Samsung mini and wasn't even the latest model. The phone never seemed to function correctly and finally died in September 2014. The phone itself is only worth £10 now and isn't worth repairing. I bought my own phone yet am still paying for that contract with the Samsung Galaxy included. Am I in the right to terminate this contract even though it has until July 2015.

The contract stands I'm afraid.
If the phone wasn't the one agreed to it should have been disputed at the time. If it was faulty you may have been able to return to Samsung for repair although pointless now if you have replaced it yourselfIt's not just about the money0
