Hi all,

Firstly I apologise if there is some information about this topic but I have done quite a lot of reading and think I'm at a point where I can't do anything but just wanted to make sure and not miss anything.

My sister uses a car that I am the registered keeper and received a PCN from UK Parking Ltd on the windscreen on 15/08/14 which she did nothing about. She told me nothing about it so I had no idea either. I've been in a temporary address where my car isn't registered and went and collected my post over the weekend (after a long time) and found the postal PCN dated 26/09/14 and a debt collectors letter from UCS dated 27/11/14 stating the usual 14 days etc.

She kept the windscreen ticket (which was valid during the time the ticket was issued) and the windscreen PCN but from what I've read that doesn't really matter?

My question is, is there anything I can do it this stage? I've taken no action as of yet (appeal or other), but if I read correctly there is a window of "opportunity" of a certain number of days after the NTK is issued. What can I do, if anything?

    as you have missed the 28 days opportunity to appeal as RK, you may have no option but to reset the clock and name the driver to the PPC , but this may not work due to there being a windscreen ticket

    otherwise its APPEAL ANYWAY , to the PPC , as RK

  • Yes I read that the clock reset trick is generally for non-windscreen PCNs correct?

    OK I was not sure if I could appeal outside of the window so I shall do that. From the newbie thread I'll take the template for appeal in post #1. Is it better to appeal by email or by post? I also have seen a "certificate of posting" mentioned many times, but I have no idea what this is and who I would get it from?

    you should always appeal, - regardless of any time delay, to prove you tried to settle the matter

    as for appeal methods, depends on the company, so their paperwork will indicate how you appeal

    appeals can always be made in writing, and the Post Office give a free certificate of posting if you ask them for it when you post it at the P.O. , so you would do this in writing , seal the envelope , address it, take to the PO and ask them to stamp it and give you the free cert of posting, so not hard at all, straightforward and easy to do

    Seriously, I would NOT be posting a late appeal by snail mail this week - kind of obvious why not! If there is an online appeal option, use it. NOW.

    You cannot reset the clock with a windscreen PCN - the driver and keeper have both missed the boat, which was a bit silly. UK Parking appear to have no website and on the AOS list of members it says they merely use self-ticketing which is highly unlikely to comply with the POFA. Can you show us both sides of the Notice to keeper (first letter) please? YOU CAN'T POST LINKS YET SO PLEASE DON'T REPLY TELLING US THAT - DRIVES ME MAD! Of course you just remove the http from the link.

    OK I missed your post Coupon-mad before I sent the appeal by email, but I used the exact template from post #1 of the sticky topic. I will post the NTK sent in about an hour or so as I don't have access to it right now so will need it to be emailed to me. Should I black out any details from the front or back (besides my address and phone number obviously)?

    I'll use photobucket and post a broken link up (hxxp instead of http) as I've seen done on here before.

    You need to blank out (redact) any personal identifying details, like your name and address, PCN ref number, location of parking event, car registration number, any barcode or similar.

    We just need to see the words used by the PPC describing the parking event and why they feel they have any case against you in the NtK.

    Yes, blank out anything they could use to identify you. We don't need to know times, car park location or ticket numbers, and we definitely don't need to know your VRN!

    As a follow up to my post earlier, I emailed the exact appeal letter to the parking company and this was the response:

    Dear ,

    Thank you for your recent email.
    Unfortunatly it is to late to appeal at this stage, you need to contact UCS with regards to your this matter.

    Yep send that as well as a complaint to the BPA by email saying your appeal is being denied and you require a POPLA code. DO NOT MENTION YOUR SISTER AT ALL.

    Just complain as keeper that you have been in a temporary address and collected your post only last week and found this Notice which you appealed straight away. So does the BPA consider it right that you should be arbitrarily denied an ADR, seeing as it is the will of Parliament, as a result of the EU Consumer Rights Directive, that ADRs must imminently be made available for not less than a year? Also, as you have shown the Parking Operator that the driver did pay and display (proof of the pay & display ticket is attached) how is it professional that they are still trying to pursue the matter with you as keeper, especially as their Notice to Keeper is not even fully compliant with the POFA 2012 anyway? Ask if this is an example of driving up standards in the parking industry, to chase a keeper who is not liable due to the failings of the NTK and the fact they were not the driver, for a charge when the P&D sum was paid and so there is clearly no loss and the Operator is fully aware of that fact?
