    She appeals as keeper and just says something such as :

    The driver (who was not me) seems to have put in our other VRN so I attach a copy of the P&D ticket purchased, which shows this to be the case. I know this will enable you to trace the payment and then you can check and see that the other car never entered the car park and you will know I am telling you the truth. There was no loss whatsoever. As the BPA code of practice expects AOS members to check for VRN errors (and I have given you sufficient info) I look forward to hearing that the charge is cancelled.



    If this ends up at POPLA she'll need a stronger appeal than that to win (and she will win) but that's all she needs for now and they may cancel. ParkingEye do sometimes. It can be sent online tomorrow and they will probably have cancelled it before Christmas, if they are in next week and not on a lengthy xmas jolly funded by the money from their victims.

    Thanks for everyone's advice - just one further question.

    She appealed online but has not received any acknowledgement of the appeal - should we expect one? I appreciate a decision may take a while to come, but as it's done online I would have expected an email confirmation of the appeal received. As it is, I have no proof that we have appealed as it was done online, and reading a recent thread about parking eye am concerned that they are ignoring it.

    They have 14 days in which to acknowledge your appeal and 35 days to make a decision. The Christmas holiday period might have got in the way a bit.

    The deadlines are those of the BPA CoP, rather than part of PoFA 2012's legal requirements, so are a bit more flexible and are not showstopper winning points of appeal.

    No one really gets excited about the 14 day deadline. PE normally respond within the 35 days, and in terms of a forum assisted appeal, are of late cancelling pretty quickly.

    Just keep an eye on the 35 days date. Come back if they fail to respond by then.

    Have you checked your email junk/spam folder for an acknowledgement?

    I didn't receive an e-mail as acknowledgement when I recently submitted a friends on-line appeal in December. It was just an on-screen acknowledgement after pressing the submit button.

  • When I appealed, I took a screenshot of the automatic acknowledgement, saved it on my computer, imported it into a Word document and printed a hard copy. I would advise anyone making an online appeal to do the same. My appeal was successful but the only communications I received from Parking Eye were by letter post. They don't appear to use e-mail, even though they ask for your e-mail address in the online appeal screens.
  • Thanks - I didn't think to do that - assumed I'd get an automatic email confirmation.

    Situation now is....
    Date Issued: 13/12/14
    Date online appeal - 30/12/14
    Still heard nothing - what should my next step be?

    apart from asking the landowner to cancel it, probably not a lot, or nothing

    they have 14 days to acknowledge the appeal and 35 days to decide , you have given them neither , you were told this in post #14
  • Just to update. I received an email today saying....

    Onthis occasion as a gesture of goodwill we will be cancelling this ParkingCharge

    Thank you for everyone's help and reassurance that this can be fought.
