PCN from debt collector ZZPS

I parked a car on a private land on 27/06/14, when I went to visit a business acquittance of my son. The businessman had pre-booked a parking slot for me. While we were there, the businessman assistant noticed that the parking attendant was putting a ticket on my windscreen, so he went and explained to the attendant that he had made a mistake and this slot was reserved, the attendant then took the PCN from the windscreen and destroyed it and said this is fine. When I returned to the car there was no ticket on the windscreen nor was one handed to me or my son. So I thought everything was resolved, didn't think of it any more.
On 29/10/14 I receive and unpaid PCN for £160.00 from ZZPS company. Since I had forgotten about this incidence, I asked them to clarify the PCN. They produced some photographic evidence showing the PCN on my cars windscreen and me car parked on the private land. I wrote to them explaining that although they have photographic evidence the parking attendant destroyed the PCN once he was given valid reason. I have been in touch with the Businessman and requested he gets in touch with Globe Protection Limited, I assume they own the land but they issued the PCN. He hasn't managed to get in touch with them.
ZZPS are perusing me to pay this invoice.
I need advice on how to tackle this and not pay the PCN invoice.

    Let's be clear: you're saying it wasn't you but your business acquaintance's assistant who spoke to the parking weasel and was told everything was resolved?

    Sounds to me like you've got a small army of independent witnesses to the facts that (i) you had permission to park where you did and (ii) the PCN was taken away and destroyed.

    I'd ignore everything if I were you. In the highly-unlikely event they tried to sue you for this they wouldn't have a leg to stand on.

    ZZPS is the new vehicle of Gary Osner, formerly head honcho of the late, unlamented Roxburghe. ZZPS should be treated with the same contempt that Roxburghe was.

    Well well well, whaddya know? According to Companies House, Globe Protection Ltd. is a dormant company. You might want to drop a line to breaches@companieshouse.gov.uk with copies of what you've received as evidence that this dormant company is in fact trading.

    I see that their website is in their trading name of I.G. Security, but they've registered it with a Top Level Domain of ".org". This is a misuse of this TLD which is supposed to be for non-profit organisations, and is something the Advertising Standards Authority might be interested in.

    Darren Mark Draycott who "runs" (is) this dismal little operation, in common with most of his ilk, is too stupid to realise that his home address is plastered all over the internet in case disgruntled "customers" want to have words with him. Here it is:

    Googling him revealed some most peculiar and unexpected hits concerning a matter that is in the list of forbidden subjects on MSE forums.

    Your advice is to ignore this but I am thinking what would they do besides writing to me and threatening to take me to court, how likely are they to take me to court?
    Never been in this situation, so difficult to make a decision?

    I'm sure Bazster will give you some more wise words on this individual/outfit when he sees your post, but if you want an idea of which PPCs are likely to 'take you to court' have a look where Globe Protection figures in the 'league table'.

  • Bazster, thank you for your response. I like the way your method of research.
    One minor point Globe Protection is active, however the company did not trade during year ending 31/03/13, so I dont know the exact status. May be I should sent a copy of my correspondence to companies house as you suggest, nothing for me to loose.
    Could you please tell me where you got their website name, so I can follow this up as you suggest.
    What if I were to write back to ZZPS and state to them that your Client is not trading legitimately and I have/will report to the appropriate authorities to get the PCN charge dropped, or just report it without informing ZZPS!
    Need to think about this.

    If they dont may be I can request similar information from Leicester court if they have taken people to court.

    What decision? It's too late to appeal (and any appeal would've been to the sham IAS anyway) so your only choices are to ignore it or pay it (and if you want to do the latter I can't help you, we don't do kow-towing to lowlife scum here, we fight them).

    I've never heard of Draycott taking anyone to court, but then before your post I'd never heard of him anyway. Most of these one-man-bands are too thick to find their a**e with both hands let alone bring a court claim, but IPC members do have the odious Gladstones Solicitors egging them on now, so who knows? Like I say, if they were idiot enough to bring a court claim your battery of witnesses ought to see them off in pretty short order.

    Your call though. But if you want to pay them, it's goodbye from me.

    P.S. could you send me a private message with the exact address of the car park? I'm often in the Leicester area and would be keen to get one of these fake fines myself for a little experiment I have in mind for IPC members.

    Globe are no longer with the BPA, now with the IPC. But for the period covered by the FOI data, they were mostly with the BPA.

    Of course, the data is but an indication, and not a guarantee of future performance. But my view would be that they're not one of those PPCs that will be prepared to spend more money on a court case than they would ever be likely to recover their costs from.

    Some of the larger operators do in order to send out 'frighteners' to 'persuade' others to pay up quick to avoid going to court, so with high volume operators the model works, but not likely for a one-man-and-his-dog outfit.

    They're not members of the BPA, they are with the other lot, the Independent Parking Committee.

    If this tinpot company, which has a net worth of £100, has ever brought a court case I'll eat my foot.
