cancel a continuous payment.

Hi some advise would be much appreciated.
I have an ongoing CPA that takes a big whack out of my account. I now am no longer working and not entitled to benefits and so contacted them asking for help. They were unhelpful and useless.
So what I have done is cancelled my debit card.

Will this be enough fo stop payments being taken? I dont have money in my account and worry that my bank will alow me to go into overdraft and charge me.

Thanks in advance.

    Who were?

You should cancel this with the company collecting the payment. Although if you've committed to a contract you might still owe them the money.

Although regulation says you can cancel a CPA with your bank, it isn't uncommon for the payment to still be collected and reimbursed a couple of days later. Often needing you to remind the bank of their obligations.

Cancelling your card does not cancel the CPA.
  • Ok on Monday I will contact my bank and ask them to cancel the CPA.

With regards to my other question. If there is no money in an account and a CPA was requested, would the bank agree and then put me into unauthorised overdraft?

I just came on here asking for advise. I am very worried about my situation and thought this was a friendly forum.

So what I am asking is this.

If you had CPA, direct debits of even used your debit card to pay for stuff in shops...if you didnt have the money in the bank would your bank go ahead and authorise it, leading you to fall into the unauthorised overdraft trap.

If you try to spend money you have not got by any means (CPA, DD, Card, etc) then the bank will either decline or take you into unauthorised OD; their choice.

Either course of action will be unpopular with the bank and may incur charges. They view it as your responsibility to manage your spending.

You should cancel the CPA. However, even cancelling the CPA does not necessarily cancel your contractual obligations with the Company concerned. So you need to persevere with the nameless unhelpful Company. ( which is why you were asked who it is)

    Ok, let's try again.

I asked a question to clarify what you've done so far. You ignored it.

I suggested the best place to cancel this was with the company collecting the payment. You ignored it. This may relate to the answer to the unanswered question.

It depends on your bank. Very possibly, yes.

OP, please read this article: http://www.moneysavingexpert.com/banking/recurring-payments

Also a bit of friendly advice: if you are asking a question and don't hear the answer you expected to hear, it doesn't mean that the advice isn't the best possible advice you could hope to get.

How do you think people ever get into 'the unauthorised overdraft trap'?

Cancel with BOTH the bank and the creditor.

    http://www.fca.org.uk/news/continuous-payment-authorities-your-right-to-cancel

How to cancel a continuous payment authority

In most cases, you should be able to cancel by contacting the company taking the payment and asking it to stop. However, you do have the right to cancel directly with your card issuer. Once you have done this, it must stop payments immediately – it cannot insist that you agree this with the company taking the payment first.

REMEMBER: IT IS YOUR RIGHT TO CANCEL CONTINUOUS PAYMENT AUTHORITIES DIRECTLY WITH YOUR CARD ISSUER

However, it is recommended you inform both the company taking the payment and your card issuer when cancelling a continuous payment authority.

You may also want to check your next statement to ensure the payment has been cancelled as requested.

Keep in mind that you will still be responsible for paying any money that you owe.

  • I've followed the MSE on instructions of how to cancel recurring payment.
Can't contact AVast in any way!! Phoned the bank who say they haven't got the facilities to cancel without contacting the company. Best of Luck to them on that. They also can't send a confirmation of our conversation! I told them it was my right but they don't seem to understand! Waiting now to see what happens.
