Three contract cancelation fee

I moved to a new area, three's network wasn't up to it so they offered to half my line rental for a month, then offered to cancel the contract which has 10 months left but charge me £104 for the phone. They then lowered their offer to £52. So they failed to provide their service and are trying to force me to by my way out of it. She told me that when I signed up for the 2 year deal, the phone came separate to the line rental and I still don't own it. I offered to return the device but she wouldn't except it. Any suggestions anyone?

Firstly.......why would they want your 2nd hand phone ?
Secondly...it isn't their fault you have moved...if the signal had been poor when you first got the phone you would have had a case for getting out of the contract.
However , you have moved and they have made you a generous offer to pay off the phone.
I don't really see what the issue is .0
