Before i appeal this PCN UKPC

Hi, i have recently had a parking ticket from UKPC for not displaying a ticket, although there was a ticket displayed. it just wasn't the "right way ". so i am trying to dispute it but the online process doesn't seem to submit for me so i am going to write in. before i waste the time posting etc i would like some advice on the letter i have prepared and the evidence shown and if i have a case and a chance of winning.

As the registered keeper of this vehicle I have recently received a parking charge notice by yourself for not displaying a valid ticket. This fine is of 100.00 which is just ludicrous. Not only do I find the price itself crazy but also the reason the driver has received such fine because the driver did in fact have a valid parking ticket and it was actually on display, it just happened to be the wrong way round (which isn’t obvious as it doesn’t state which way to face the ticket clearly on the ticket or on the signs around the premises. The parking inspector could clearly see a ticket had been bought and a serial number of the ticket was still present. ( see attached photographs) but still decided to write the driver a ticket for 100.00 which by the way wasn’t presented correctly on the ticket and is hidden behind text which is just deceiving which is another grounds for appeal( see pictures for proof) .

According to the protection of freedoms act 2012; section 56 schedule 4 “ charges for breaking a parking contract must be reasonable and a genuine pre-estimate of loss” this means the charge must compensate the landholders only for the loss they are likely to suffer because of the parking contract being broken. Which in this case neither has happened as I said before the driver did in fact purchase a valid parking ticket (see pictures attached) 3 hours before inspection. This can also be backed up by the onsite CCTV camera and ANPR cameras on site.

The driver uses this car park 5 times a week through-out their university term which is 36 weeks. On a Monday it costs the driver £3.50 and for the rest of the four days it costs £2.50 per day this means the driver is spending 13.50 a week on your car park giving a total of £486.00 per university term. This is £486.00 of the driver’s money you shall no longer be seeing because of this ludicrous fine as the driver will be parking else-where in future unless this fine is cancelled. You are at no loss and the driver wasn’t in breach of the health and safety at work etc. act 1974 so you have no grounds to pursue this further but if you continue to take this matter further and do not cancel the ticket that is £486 you will be losing to an opposing car park for the next 2 years at least giving you an estimated loss of £972.00 simply because of a ticket being the wrong way. And I will also be taking this matter to POPLA.

    Hi there,

    Try not to include mitigation in your appeal (ticket was the wrong way up) because PPCs will ignore this.

    If I were you, I'd just send in the template from the NEWBIES thread and go from there. Follow the advice and you will win
  • is this a winnable case? i know im in the wrong for not correctly displaying which is a genuine mistake, i wouldnt even mind a reduced fine but 100.00 is crazy

    @OP - how much of your life have you taken to compose and write your appeal (above) when there is a well-researched, well-crafted (by experts) already in the NEWBIES FAQ sticky ready for you?

    Three questions:

    1. What outcome do you expect from your drafted appeal?
    2. Have you received a Notice to Keeper?
    3. Have you read the NEWBIES FAQ sticky?

  • yeah i've read the FAQ but i didn't think the appeal letter suited my case as im kind of at fault, and for the outcome id love for it to be cancelled, or atleast reduced. and to be honest its took me less than 30 minuites to write that up so theres probably a few mistakes in there.

    Of course it's winnable, why do you think you are in the wrong, why are you calling this ridiculous speculative invoice a fine, and worst of all why would you even consider paying anything when you paid for your parking?:cool:

    To be honest, I know their in the wrong here as I have paid my parking as shown, the only reason i would accept a reducded cost is because of all the hastle and the storys of court summons etc.

    not yet, mainly because i wanted to get the appeal done before the reduced offer is removed. but i still havent sent the appeal off yet

    Then you haven't researched very well, this is UKPC not Parking Eye!!
    The "reduced offer"is a bribe to get you to panic and pay up don't fall for it!
    UKPC are just scummy chancers anyway!

    I've done my research, and know not to appeal untill i recive the NTK. its just that if i leave it and appeal later im going to lose out on the reduced offer even though i know i should'nt be paying it. if i wait for the ntk and then appeal and end up losing im stuck with a 100 fine apposed to 60. either way i cant afford to pay either 'fine' but 60 sounds better than 100.
