Faulty belt from Gucci

Hi I'm after some advice regarding a purchase from Gucci.

So I received the belt around 19/11. it was for my husbands birthday which was 28/11. The second time he wore it the metal G buckle just snapped off. When you are paying £200 this is not what you would expect?

so I've contacted Gucci and they have said I need to return it their after sales department where they will either send it to a local repairer or to Florence to be inspected.

Now given the amount of time I have had this, I'm not too happy with their response.

Am I entitled to request a full refund rather than having it repaired? I bought it on my Barclaycard, would I be able to go through them?

Any help on this would be greatly appreciated.

    The Sale of Goods Act has a concept called acceptance. When you purchase something you are allowed a reasonable opportunity to inspect it to check it conforms to contract. If you haven't explicitly informed the seller that you accept the belt then acceptance will occur after a 'reasonable' time. There is no definition of what reasonable means, so it depends on each specific case.

    If the goods are found to be inherently faulty before acceptance then you can insist on a full refund and the retailer can't refuse. If they are found to be faulty after acceptance then you can't insist on a refund if a repair or replacement is cheaper for the retailer.

    Given it has only been 3 weeks since you received the goods then I think there is a reasonable chance that acceptance has not occurred. At some point in the future I think that the reasonable time will be set to a minimum of 30 days, and you are within that time.

    If you paid on credit card then your card supplier are jointly and severally liable for the contract under Section 75 of the Consumer Credit Act. Anything you can claim against the retailer you can also claim against the credit card provider.

    I wouldn't be surprised if both the retailer and credit card resisted the request for a refund though. You'll never know till you ask though.

    They are surprisingly a nightmare to deal with, you live and learn! From what I have read online, their goods aren't of the best quality, nor is their customer service, wish I'd known that before. Fingers crossed!

    Regardless of acceptance in this case they do have the right to inspect it to confirm it is faulty and not damaged through mis use.

    Can you confirm the url as I think that is what Holly was getting at. What you or others might think is the correct website might not be and it might be one of those from our far east friends

    £200 for a belt that is "not the best quality"???? At least you bought it from their own website so it should be genuine and not a fake, or maybe a cheaper fake would be just as good quality? What people will do for the sake of a "designer label".

    I hope you get your refund ok, then you can buy a different belt, better quality for less money, and take him out to dinner on the change.
