  • We have seen the contracts and they are with our solicitor but we have not exchanged as of yet. I have spoken with our solicitor and they are going to pick through the contract

    That makes things clearer. You don't have any rights then, but neither do the builders. You could try renegotiating before you do exchange.
  • Hi

    So we have had some news this morning. Basically the local council are the ones who have put the money forward to the builders to build the houses. So its not like a normal developer.

    The person at the council who is very high up has said that he is willing for us to exchange contracts and move in without a completion date. All we will do is hand over our 5% deposit to them and they are happy to do this. If anything was to need doing to the house then we would have to move out which is not a problem because we can go to family in the area

    Obviously we are going to consult with our solicitors on this and get everything in writing before we agree to anything.

    Has anyone heard of anything like this happening before or done this before.

    any info would be greatly appreciated. I mean I can't see the council offering this if they are are not 100% on everything because we could take them to the cleaners if they did mess up after exchange.

    If you haven't exchanged then there's no binding contract.

    Get "the deal" in writing and ask your solicitor to consider it.
    I suspect it will be a non-starter.

    I don't really think it's any sort of deal. What do you get from it?

    As with any new build I would ensure you have a professional snagger completely survey the house before exchange or completion. Whilst developers don't like it, you wouldn't buy a car before they put the paint on it.

    A few more weeks to ensure you have a quality product, that you don't live on a building site is a small price. I would be asking your solicitor to draft a letter listing your costs and requesting them to pay them; or you will not be exchanging or completing.

    They may be very high up but they clearly don't understand the legal position. It's pretty unlikely that they'll let someone move into the property before completion after receiving legal advise on the matter.

    if they mess up after exchange then I definitely have more rights than before exchange.

    I thought this forum was meant to be a friendly and inviting place for help. Not somewhere to get shat on from a great height and everyone dampen the mood
