New Build Delayed

Hey
So me an my partner are buying a new build which should have been completed in October. They promised us that we would be in by xmas. We received a phone call today to say that the NHBC have been on site and they need the builders to change the paths on every house to stop the damp penetrating into the house.
What rights do we have to actually sue?
Cheers

Lol this is normal for a new build. Ours was about 4 months late if I remember correctly.
I think you will find that your T&Cs you signed allow for delays like this, so no opportunity whatsoever to sue.
Read your T&Cs carefully, but i think you will find they have this covered...Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Indeed. Any rights are in your contract (which you should have a copy of). At most there is likely to be a date at which you are entitled to walk away from the contract, but I doubt you can "sue" anyone.0

What does the contract you signed say.0 -
This is normal. Mine was 7 months late.0

Read the contract you signed. In my case, it allowed for 6 months of delays without any consequences for the builders. After that, you likely have the right to walk away or it might outline compensation if you choose to wait.
My house was supposed to complete end of February/beginning of March at the latest. Finally completed in the last week of May by the hair on my teeth (could just have well ended up with another month delay because the gas company put the main line in the wrong place), delays, alas, are normal.0 -
Hi
So what rights do we actually have as we are still not in and they have now said the soil has failed the test and they are going to have to dig up all gardens that have been laid, all driveways, all shared parking areas and lay some special soil.
Also the NHBC decided on the 12th December they wanted a fire door on the downstairs toilet because the washing machine goes in there. This has not been completed and is yet to be changed. We have seen the original plans and this was showing as not needing a fire door.
Our date was mid November and we are now being told end of feb beginning of march.
My partner was re located in her job hence the reason we bought the house to be 20 mins down the road rather than 2 hours.
She travels 4 hours a day to work covering around 70 miles each way.
Surely we are able to claim something from them, to do with the !!!! ups we have been having.
The builders, the architect, building regs, anyone????
We are literally at our wits end and to top things off our mortgage runs out on the 11th February.

Well what does your contract say about delays? We can't read it from here.0

See my earlier comment. You need to read the contract, or get someone to read it for you.0

We're all assuming contracts have actually been exchanged....."You were only supposed to blow the bl**dy doors off!!"0

Op better to have it done before, than deal with problems afterDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
