POPLA won't be interested in any breach of the BPA's CoP, but it is most definitely an angle against which to raise a strongly worded complaint to the BPA (see NEWBIES sticky, post #6 for Steve Clark's email addy) - so let them have both barrels and bring the Equality Act into the frame as well.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Dear Sir,
Following our visit to Pizza Hut, XXXXXXXXXXXXXX on 18/10/2014, two of our party received £100 Parking Charges from Civil Enforcement Ltd, they have rejected our appeal.
There were 13 of us in the party with three vehicles parked in the Pizza Hut car park. I am disabled and a wheelchair user and together with my wife and five children (three of which are foster children) we then entered the restaurant entrance, which was a distance of approximately 15 feet immediately in front of where we had parked appropriately including correctly displaying my Blue Badge.
We quote the British Parking Association CoP regarding Blue Badges. The Code states: "If the landowner provides a concession that allows parking for disabled people, if a vehicle displays a valid Blue Badge you must not issue it with parking charge notices". By providing marked disabled bays then clearly a concession has been provided, it then begs the question why has your member breached the BPA's Code of Practice by issuing a PCN to a vehicle subsequently displaying a Blue Badge whilst parked?
We demand in the strongest terms that this issue is taken up with your member and that matters are promptly attended to.

Hi CM, We just assumed that there was nothing to add / we were asking a daft question hence no response. This was sent to the BPA early yesterday. In what way does it suggest who was driving? We didn't think it too dissimilar to the original email sent to CEL (see #1 and your reply #2)? Cheers.0

Amidst we wrote to the CEO at Pizza Hut and they have contacted CEL. They report that CEL are prepared to cancel the charge notice but cannot do so since it is now with POPLA. Would this be correct, or as we suspect that is bunkum? Pizza Hut did say that win or lose they are confident that they will 'resolve' the issue. Just to check, on submission on the 4th Jan to POPLA (London Councils) we have received an email confirmation of the appeal, but should we have a hearing date by now?0

Indeed - pure bunkum. CEL can easily cancel the PCN and inform POPLA they have done so. (In which case you get a notification from POPLA that this has happened).
Not sure, but I think CEL may even save the POPLA fee if they cancel the PCN.0 -
Wouldn't be any different really to CEL cancelling a court claim the day before the hearing (If anything even easier).
According to the Co-op CEL were not willing to listen to representations from the landowner. This may be due to the fact that CEL got kicked out of Co-op's car parks though. Hopefully they are still in love with Pizza Hut.0
