    They even give their address as 'Brighton & Hove City' which isn't a postal address at all. And they are not at Western Road of course, it's a mailbox.

    Anyway you haven't got the Notice to Keeper in the post yet, have you, so do nothing until that arrives anyway, in 2015. The keeper is the best person to send the appeal and that's a dish best served cold, when the NTK (or whatever: 'formal demand/final notice/scamogram/jackanory' whatever they call their first letter) arrives.

    I would think not, unless of course the driver is also the RK, and telle them so..

    Another point, contractual charges are subject to v.a.t. Has v.a.t. been mentioned on the NTD? If not then it looks like a breach, and actual loss applies.
    You never know how far you can go until you go too far.

    Yes you are. There never is a contract with the keeper. POFA 2012 doesn't require the keeper to enter into a contract, it makes the keeper liable for a contract entered into by the driver.

    The driver denies that any contract exists between him and Sussex Security Solutions Ltd. However, if you assert that there is a contract, please note the following:

    On behalf of the driver, by whom I am duly authorised, I hereby cancel any contract with Sussex Security Solutions Ltd. for the service of parking at <location> on <date>. This cancellation is given under the terms of the The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

    I wonder about this tactic. Assuming there was a contract in force, it would have been for a service that OP has already used and for a finite period. It is not an ongoing contract that can be cancelled as it is no longer in force. It's like cancelling an expired motor insurance.

    The time to cancel such a contract would be during the period it was in force- when you were still parked.
