Contractual payment charge

Options
Hi, sorry but I'm getting very confused by the forum, I don't use them much so please be gentle with me.
A few days ago we got a contractual payment charge for overstaying in a car park by 6 bloody minutes. The car park is private and is affiliated with IAS (that's the bit that confused me as I just read a thread saying not to enter into appeal with them).
Basically, the reason we were 6 mins over (actually is was nearer ten by the time we got back) was that my son did a runner and we had to chase him, explain to him why that wasn't a good idea and then go back the other way.
For that 6 minutes they want £100!!!! Or £60 If I'm a good girl and pay up within 14 days. The car park was only £1 a minute anyway.
I've read the piece on the money saving website about private car parking 'fines' and have started drafting a letter. The signage in the car park states that there'll be a charge (I have photos) and the only evidence I have is a witness statement.
I'm assuming I do the whole letter thing to the landowner with mitigating circumstances and disproportionate charges etc and then when they reply to tell me to pay anyway, what do I do from there if not go to IAS?
Thanks in advance

OK. Was this a camera or a windscreen ticket?

I hope it is the former. If so, have a look here http://media.wix.com/ugd/bd9e08_b57f0768f7d9482db5b3c2de70e9f4b2.pdf Page 13 17.1 17.2

Date of contravention and any documentation would be appreciated too. What times did they claim for entry and leaving and was the car park busy or half empty?

    I hope that's a typo!

It's G24 I assume? So it depends on the signs. I hope when you say you are drafting an appeal you DON'T mean you have based it on an MSE article about 'parking fines'. The first appeal is already written for you and is in the Newbies thread. Don't devise your own appeal. Don't use the MSE article.

Re your question - another question - what do you think we all did before IAS and POPLA existed, just 2 years ago?! This is what we did for YEARS:

Like in that cheerful thread, we LAUGHED AT and IGNORED any debt collector letters. Same now.

  • Guys Dad, the car park was half empty, it was Saturday morning but earlish so shoppers hadn't started filling the spaces yet (shops don't really open till 10 here). It was a windscreen ticket and it said the vehicle was observed between 09.49 and 10.02, the time of breach was then 10.03

Coupon-Mad - ha ha ha, what a wally!!!! Yes it was £1 an hour not a minute (face palm!) not sure what a G24 is but it was issued by parkingenforcemet sussex security solutions, read some stuff about them in other threads but not sure what to make of what I read, whether they're cowboys or hard to get around.
Signs in the car park say:
    'parking is permitted for:
vehicles fully and clearly displaying a valid parking permit/pay and display ticket and parked fully within the confines of a marked bay'
    etc etc
by parking or remaining at this site otherwise than in accordance with the above, you, the driver, are agreeing to the following contractual terms
You agree to pay consideration in the form of a parking charge notice in the sum of £100 to be paid within 28 days of issue. This is reduced to £60 if paid within 14 days
you accept that a parking charge may be fixed to the front windscreen of your vehicle.
you will be liable for additional parking charges for each and every subsequent 24 hour period (or part thereof) that the vehicle remains or if it returns at any time.
    etc etc

ok so I DON'T use the MSE article, I use the one in the newbies thread and then ignore everything else, right?

Thanks for your help. I'll keep you posted.

Oh, not G24 then - SSS = allegedly 'cowboys' (and I am in Sussex so I know about them). Yes, send the usual appeal from the Newbies thread.

Please can you show us both sides of the postal Notice? Haven't seen a SSS one for a while, there may be obvious flaws in their argument & Notice.

Change the http to hxxp when you post the URL to your photos of both sides of the postal Notice.
