Debt Recovery Plus - Advice Wanted!

Hi everyone,

I have been reading a lot of advice on these forums and I feel more confused than ever about my situation! I hope I'm not being thick but here is what happened to me.

I received a parking charge notice left on my windscreen on 02.09.14 by a PPC. It was in a carpark to a block of flats, I was sent there to perform an eye examination on someone who could not leave their flat, as there was nowhere else to park I left a notice in my windscreen exaplining what I was doing and how long I would be. However when I returned I had the fine there and after speaking with the gentleman who I had just visited he reassured me that if I ignored all letters I would be ok, so this is what I decided to do.

After then receiving multiple letters from DRP I decided to do some research online and I followed some advice where I sent a letter to them saying the fine has been denied and asking them to stop contacting me, thinking this would be the end of it.

I then received a letter in reponse (which as a new user I can't post the image on here) which basically said that if I don't pay £150 by 10.12.14 they will recommend to their client that court action be taken. They also drew my attention to an important court "test" case where the parking company won. (The letter also said that internet template letters will not resolve the matter?!)

My question is where do I go from here, should I continue to ignore the letters or should I send another one back? I appologize again if I am being thick and the answer has already been given!

I appreciate any advice given!

Thanks!:)

Read the Sticky thread for NEWBIES. This will explain why it was a bad idea to ignore letters from a PPC but is OK to ignore letters from a debt collector. The NEWBIES thread will also explain what you should do next.

Was this in England/Wales or Scotland/Ireland? Which PPC was it? Did you get a NTK.

The important case will no doubt be the Beavis vs parking lie. I bet the PPC didn't tell you this has been appealed and if overturned will cause all sorts of consternation in the PPC world.

...and lastly, it is not a fine.

  • Thanks for the reply,

Yes you are right with the case there! It is in England.

I stupidly threw away all my letters thinking there were just a scam! I don't remember getting a NTK (unless this was the initial notice attatched to my windscreen).

Ah so that's what I gathered from the NEWBIE thread, as the letters are all from DRP do I continue to just ignore them?

The NEWBIES thread explains all the acronyms to save the regulars having to explain things over and over again. The fact you don't know what it stands for means you need to re-read the Sticky again.

That's what the NEWBIES thread tells you to do.

Who is the PPC? This is very important as some are relatively harmless and others will pursue disabled terminally ill people to court.

  • Oh no! It was UKPC, are they the monsters?
  • Do you think I should take this advice:

The Prankster, in this situation, would take the initiative, write to the debt collector stating that any debt is denied ( I have done this already), and write to the operator, appealing the charge and asking for a POPLA code; meanwhile also stating that any legal action should be preceded by a letter before claim complying with practice directions.

The worst I am aware of is parking lie. I don't know if UKPC do court; perhaps one of the experts can advise you.

Some PPCs don't send a NTK but go straight to debt collectors which is a breach of the BPA CoP, and warrants complaints to said BPA and DVLA. Appealing direct to the PPC demanding they cancel the ticket or give a PoPLA code is therefore a good idea.
However, in your case you say you threw everything away so it is not clear whether you received a NTK but ignored it, or whether you didn't receive one at all.

However, the Prankster (may live for a thousand years) is very knowledgeable and this is probably your best approach.

Oh just ignore it seeing as you missed POPLA. No need to start a new thread about DRP, please spare us yet again from being asked to discuss the same old letters:

Please click there and read it. We've ignored this stupid letter chain for a decade and to find threads galore simply needed a Google (and a giggle):

  • I am in similar situation but did not get a window sticker. Been ignoring and throwing letters. Now got DRP letter. On my DRP letter the creditor is CP Plus Ltd, is this my PPC?

Should I just ignore it too?
I've not sent any appeal or anything as of yet.
    Cheers

    I have a question.

Some people are saying to ensure appeal is put into PCS after receiving NTK and then complain to BPA if PCS doesn't issue POPLA.

However, some are saying to completely ignore everything as any form of communication with the PCS is basically informing them that you are acknowledging the validity of their ticket by responding and now they will not leave you alone because you have responded to them.

One person I know has not responded to a single ticket they have been issued over the last few years. They get issued tickets every week and don't do any responding to any PCS or BPA whatsoever. They are advising not to do anything?!

If the PCS is not following BPA rules and issuing a POPLA after writing to them, what is supposed to be done then?
