Thanks for your help kind people, i have sent an email to parking eye and will speak to the court on Monday. Having received another court date i was worried that maybe paying the 'without prejudice save as to costs letter' hadnt meant the fine was settled.
As parking eye are robbing gits i wouldnt have put something dodgy past them. I now feel confident that I can resolve the situation and will update next week.0 -
If it were me, I would not press to hard to get this thrown out. Let them tie a noose around their necks and pull the lever at CC.You never know how far you can go until you go too far.0

How much was the original ticket for? From what I've seen they tend to be £85. Even if the judge did find that they could claim for the remainder on the principle in Foakes v Beer, they would only be entitled to the extra £25.
Clearly it makes no sense for PE to chase a debt of £25 when they have offered to settle for £60 and this was paid. You'd think this is what they want (scaring people into paying up before court). It sounds to me like there's possibly been an administrative !!!!-up their end.
As andy_foster points out, best starting point may be to contact them to let them know about the egg on their face. Failing that it would look like OP has promissory estoppel as a defence. Certainly there's been an unequivocal promise which it would be inequitable to go back on. A reliance on the promise shouldn't be too difficult for the OP to demonstrate.
Of course there is also, as alluded to above, the possibility of the OP getting their money back in addition to the claim being thrown out by counter-claiming that no debt was owed in the first place.0 -

I was thinking along the same lines. But wouldn't O.P have to submit it in the defense evidence at which point parking lie would pull the plug anyway.0 -
Might be a chance to report parking lie for attempted fraud?0
