apparently there is a Statute of Limitations

Hi everyone,

I will try and keep this short, sweet and to the point :)

So, I had a loan and a CC, I moved abroad but didn't manage to locate work and it came to a point where I had to pay either my rent or my CC and loan.

9 months later, I returned to the UK to try and fix everything and take care of a few loose ends, I contacted my bank to get things going again and they told me to contact a collections agency. I did this and started making payments monthly.

Once everything was taken care of I left the UK again and continued to make payments for about a year... anyway I was suddenly hit by a huge dentist bill and after paying that I didnt have enough to pay my debt (would be late by 3 days). I contacted the agency and was flat out told that if I defaulted i would have to pay the whole amount at once.

I told them that they were being ridiculous and that was not an option, I received a lot of threats from them and eventually I told them to call me once they decided what they wanted from me, I then ended the call.

So, fast forward to now and I want to find out if the debt still stands (its been just over 6 years) I also just found out about the statute of limitations now I am researching.

I want to find out if I have been issued a CCJ, Id also like to check my credit as I am now in a place where I want to potentially make a deal on the amount owing and pay that off. What I do not want is to check this info and all of a sudden be chased for a CCJ or old debt.

so summarize: is it possible to check my credit/ CCJ website without risk of being flagged and then have a knock on the door. I just want to have the ball in my court when I get in contact to make a deal to write it off.

    Do you currently have any lines of credit open? Do you have a UK bank account at your current address? Are you registered to vote? If the answer to any of these is yes, then I would imagine that the Credit Reference Agencies already have your current address and that you have nothing to lose by checking what info they hold on you. Either by requesting your statutory report for a small fee, or taking a free trial of a premium credit monitoring service.

    the problem is, if you apply for a credit report you will need to supply any old addresses for them to give you an accurate report. once you the cra update and link you to old addresses, the debt collection co, if they dont know where you are now, they soon will do!
    i wouldnt have thought this debt could be statute barred after 6 years because you have originaly aknowledged the debt anyway.

    But surely if the OP has any live credit accounts with up do date contact details, or is on the electoral register, then the CRA's will already have linked his/her previous accounts.
    OP doesn't make it clear if the 6 years is since the date of the original default, or since he/she last acknowledged the debt.

    Hi, no I currently have nothing linking me to te uk any longer except an expired passport. Thanks for the reply

    That was my concern. Also, I have previously acknowledged the debt, so because of this the statute does not apply for me? I have not spoken to anyone in regards to the debt for over 6 years now. I was under the impression that the company not getting in contact would have fallen under the statute?

    That's great, thank you I will take a look. Just a question, would I put my last known address?? I assume that would give the most accurate info.

    When did you last acknowledge the debt as thats when the 6 years starts from eg you last acknowledge it in December 2008.

    The last time that I acknowledged the debt was September/ October 2008. So 6 years and 2 or so months ago
