Question regarding Tenancy Deposit
Legacy_user
I'm soon to be handing in the notice on my tenancy. When I originally moved in to the property, I was sharing with someone so we split the deposit 50/50. At the end of the fixed term, she moved out and I paid her 50% of the deposit, essentially making the deposit all mine. I then signed a new fixed term contract with a different friend but I never asked them to pay towards the deposit, so it's 100% mine.
My question is, am I going to have any trouble getting the deposit back, since I noticed on the certificate of registration for the tenancy deposit scheme, it's got my name and the person I was sharing with originally. Am I going to need to get in contact with her to "unlock" the deposit?

You piad the other person their full deposit? What if there are legitimate reductions?0

It was several years ago now, I'm happy to take the hit on the deductions.
She moved out after six months, I've been here a further 6 years.
My concern is the letting agent said it was fine to leave the deposit as is when we signed the new agreement with the new tenant. Looking at the certificate, I'm not so sure that was correct...This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Joint tenants' deposits can be protected as individual deposits or more commonly in the name of the lead tenant.
https://www.depositprotection.com/help/browse/custodial/agent-landlord/deposit-submission
You could speak to the landlord/letting agent/deposit scheme to see what has happened in your case. Since the LA said it wasn't a problem then it is probable that it was in your name as the lead tenant.
What should have happened was that the deposit was returned and then re taken at the beginning of the new tenancy agreement. often (as you have found) LAs don't bother to do this!
So ask. If it is in both your names then I guess you may have to sort it out with the original joint tenant.0 -

Are you now on a periodic tenancy;
We will only agree to continuing protection if the fixed term tenancy agreement remains in place, there is at least one of the original tenants remaining party to the agreement and the tenancy has not lapsed into a statutory periodic.

Yes, we are now on a statutory periodic tenancy. I believe the deposit is with TDS?
So if I need to get in contact with the original tenant, do I just need to get her to write a letter saying the full deposit should go to me?This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Something is seriously wrong here, the agents were wrong ( no surprise ), the deposit should be in your name now. Did the new person not pay one? - just saw they didn't.
The LA and LL have been irresponsible.
You need to agree this.. They pay you back your deposit by cheque or bank transfer then claim the amount from TDS0 -

The LL....
The deposit is so messed up at the moment. I don't think it's protected correctly. But equally your ex flat mate could get half again, or god knows.
Tell the ll to pay you back by bank transfer and claim the deposit from the scheme. Think that's the quickest way to resolve this0
