  • Thanks. Is it worth while trying to get them to obtain a copy of the signed agreement from provident? A friend of mine used to work for provident and they've said that providents record keeping isn't the greatest so this might cause it to drag out a while longer as well.

    Your problem would be this, making a CCA request, a request for a copy of your credit agreement, would acknowledge the debt, thus re-starting the clock.

    It depends on how you intend to deal with this, either the SB route, in which case you need to bog them down with technicalities, without acknowledging any debt to them, or, hope they cant provide the agreement, and go down that path, you need to choose.

    Don't you need to acknowledge the debt 'in writing' to reset the clock though?

    Requesting an agreement by telephone stating that the reason for asking is that you don't believe you had an agreement in the first place might buy some time (because you're not really acknowledging the debt, and if you do accidentally it's only verbal)? Phoning has it's own dangers though, as you'll probably be bombarded with 7-8 calls per day until this is resolved.

    Probably worth sticking it out with the prove it letters and keep that dispute dragging along until the SB date hits...

    Yes, an acknowledgement has to be in writing.

    So does a formal s77-79 request under the consumer credit act, accompanied by £1. If carefully worded a cca request would not constitute acknowledgement but it's an arguable point.

    Sedulous is right that nothing you do by phone would cause a problem (as long as you withhold your number) but personally I would just not engage with them as any contact just seems to encourage them.
  • I'll send something to them in writing requesting further proof of the debt then as I don't think the statement they sent me details that much information as proof. Is their certain wording I should be using for requesting this and any other information I should be requesting? I'm thinking they shouldn't hopefully be able to find anything else since in one of their initial letters where I didn't respond they offered me a huge discount on the account if I got in contact with them, from reading previous posts I get that this is sometimes a sign that they don't have too much relevant paperwork.

    Wait for them to chase you again before writing anything back. Don't forget that the primary objective is time wasting to get to the statute barred date - don't hurry anything along that doesn't need hurrying.
  • That's me got s chaser letter through from them now asking me to phone them to discuss repaying to prevent further action being taken. It's pretty shocking them chasing me already after me waiting 3 months for them to respond to my prove it letter!! Should I write back to them requesting more paperwork?

    The letters you are getting are automated, computer generated drivel designed to let you know they haven't gone away.

    Ok, you sent the provit letter in January, its long overdue a chase up, write to them again, state that you wrote in January 2015 asking for proof of this debt, and so far no proof has been forthcoming, remind them of there obligations, as set out in the original letter, blah blah, and to either provide you with written proof of the debt or never contact you again.

    Its hard to advise really, as you think it may be near the SB date, and requesting a copy of your agreement would basically say this account is mine, in the end its going to be down to how you want to play it.

    If you go the SB route, ignore for now, but keep a keen eye on any post that comes, or, do a CCA request and chance your arm that way, in the hope they don't possess an agreement.
