    Thanks for replying! My husband received the Pre Legal Assesment letter today for a debt he believes is over 6 years.... We're going to send the letter to them that you posted above about information regarding the debt! Good luck with yours :o
  • Thanks, you too! I'll post an update once I hear from them. I'm currently in the middle of a mortgage application and starting to worry that this is possibly something which could wreck it altho it's not showing on my credit file so that's a good thing I suppose!

    I've finally received a reply back from Lowell regarding my letter I sent off requesting proof of the outstanding debt. I have linked the scanned letter and statement they have sent me out. Any ideas where I go from here? They still haven't actually sent out anything signed or any documents showing the debt being sold to them by provident. The statement they have sent out doesn't show a breakdown of any payments made either, just the repayment terms and again doesn't show when the last payment made was.



    Not really sure where to go from here.

    Ok then,

    If you belive 6 years has past since your last payment, then I would send the statute barred letter, and see how they respond to that, has it been more than 6 years now ?

    Edit, just read up, no it hasn't has it, you could try to drag it out till SB date, if Lowell go to court, you will get a letter advising of this, so will have plenty of time to arrange payment etc if they go down that route.

  • I don't think this will be stat barred until around December this year, it's 5 years in Scotland if I'm correct, they haven't advised when the last payment was just that the agreement was taken out in October 2010 and going by the statement linked there were only a few payments made after this date.

    Do I go down the route of requesting further proof of the debt as all I've had from them is the attached statement with no breakdown of payments made, signed agreements etc.

    Yes, push them to provide a breakdown of payments etc, anything to drag it out a bit longer.

  • Cool I'll try that. I previously sent them the prove it letter which was back in January I think, it's taken then nearly 4 months to get back to me on that. Is there a further letter template I can use requesting more information or would I just type this up myself?

    You could always try phoning the original lender to find out if they will tell you the payment dates you are looking for?

    I did this with an outstanding Vodafone debt that was being handled by Lowell. I phoned voda with the details I had (which were few) asking when I last made payments etc and the advisor told me everything I needed to know to confirm it was statute barred. Lowell responded very quickly to the SB letter and I never heard anything again.

    If not SB yet you can still drag it out with Lowell, but at least you'll know exactly how long you need to drag it out for...

    If you know the date and that confirms that it's statute barred, then send the statute barred letter.

    If it's not statute barred you will hopefully at least know with more certainty how long needs to pass before it is and then it's up to you whether to attempt to drag it out by continuing to request statements etc from Lowell until that date.

    Bear in mind if it's a long wait there's a possibility of them obtaining a CCJ so if that's the case it might be worth considering your repayment options.
