Update: The Prankster has been in discussion with the BPA. I do not know the full extent of this discussion just to say the BPA state "that they were very interested but that as the ticket was issued by VCS only the IPC can deal with it".
Prankster suggests contacting IPC on at least the following grounds:
1) There can be no contract with VCS as the signage clearly states the site is managed by Excel Parking Limited.
2) The signage does not list 'failure to display a valid ticket' as grounds for issuing a parking charge, and therefore the Unfair Terms in Consumer Contract regulations 1999, paragraph 7 applies, and the contract must be interpreted to the consumers best advantage
3) The NTK is not compliant with POFA 2012 and so the keeper is not liable. The burden of proof lies with the claimant to show who the driver was.
4) The charge is not a genuine pre-estimate of loss.
Prankster notes - VCS have previously filed documents showing their average cost per ticket is under £20, and this is fully explained at http://www.parking-prankster.com/excel-parking.html. There was also no initial loss to the claimant, only to the landowner; the entirety of the charge cannot be monies to reclaim a loss of zero.
I think this covers advice from this forum (hoo hoo & coupon mad) while others like castle have said appeal to Excel & get a POPLA code. Has anyone any other advice to add eg: contact Excel with same info or await the IPC response. Thanks, Mickey.0 -
You could send an amusing letter to Excel, I am sure people can better this one as I wrote it in haste:
Dear Excel,
I see from your signage that you purport to 'manage' the car park at xxxxx xxxxxxxx.
I am writing to alert you to the fact that another firm are muscling in on your manor and they are not a BPA AOS member. The firm in question is VCS - a familiar name to Mr Renshaw-Smith I expect - but why are they issuing fake PCNs at that site instead of Excel? Is it because you always lose at POPLA, perhaps, when faced with an appeal about your lack of GPEOL? So you have decided to send out VCS versions instead and hope no-one notices? Have the two companies merged or did someone in the joint offices get confused and sent a VCS version by mistake? Why is one a BPA member attempting to use a 'POFA' Notice to Keeper letter yet the other is an IPC AOS member, now renowned for having dropped the POFA and 'assumes that the keeper was the driver'.
