    I am just quoting the relevant cover.....
    You are selectively quoting and choosing to ignore this bit from the opening paragraph on page 1 of the same document:

    The Motor Legal Protection will provide: a service (including legal assistance and representation if necessary) to recover any uninsured losses arising from the accident;
    If you have complaints regarding a claim you should use the insurers complaints procedure.

    Well as I have already said, my excess at least was an uninsured loss I did not want to pay.

    In the end it was more hassle fighting Admiral/Albany than pursuing the third party directly myself; I certainly wasn't going to wait months with a damaged car while a complaint was investigated. Anyway we aren't getting any further with this discussion; I have nothing more to add.

    If you didn't want to pay your excess this may explain why you went with Albany (as had they repaired your car then there would have been no excess to pay).

    (You couldn't use your legal cover to prevent you paying your excess - that was something you agreed to pay when taking out the policy. So you would have to first pay your excess then use your legal cover to pursue the third party to get reimbursement)

    Maybe various people from Admiral and Albany tried to explain all this to you, but gave up when they kept hitting the brick wall we have encountered in this thread!

    I was rear ended 2 weeks ago. I am also insured with Admiral. I was passed to Albany Assistance for my hire car, which I have now given back. Admiral dealt with the taking away of my car, writing it off and paying me the money for it, I didn't lose my excess as the TP admitted liability prior to the pay out. Albany only gave me a hire car. I was passed to 'Admiral Law' for the other losses (and strongly urged to make a whiplash claim, though not in so many words) which included the insurance excess waiver with Albany and the phone calls to my insurance company. Neither being passed to Albany or Admiral Law were given as options just sold as 'part of the process'. I needed a hire car and was told I couldn't claim it back if I hired my own.

    You were mislead.

    You can be certain that the third party's insurance company will be getting the bill for your hire car from Albany (which will be a lot more that they have to pay than had you hired your own and claimed it back off the same insurer!)

    Did the cheque in payment of the write off value of your car actually come from Admiral?

    My cheque came today from esure, minus my £200 excess. Hoping to get that from Aviva in "3-5 days". Getting shot of the hire car tomorrow. All settled in two weeks, which is excellent.
