Receive pcn from euro car parks for parking at sainsbury walthamstow carpark

On the 22/11/2014, I entered SAINSBURY-walthamstow car park which took me 25-30 minutes to get a parking because it was very congested with vehicles trying to get in and out, in other words it was a traffic jam. I quickly went to the shop and spent about 1hour and 10 mins in there. I rush back to my car to try to give myself enough time to get out before my expired time,because of the traffic jam.Unfortunately traffic was at a stand still, I was even falling asleep, I spend 47+ mins in the car park trying to get out. I've now receive a PCN letter on (01/12/14) letter dated 11/27/14 to pay £70 within 28 days from 11/27/14 or £40 within 14 days of 11/27/14:mad:. Its not my fault there was a traffic jam. I know a lot of people got this pcn for that day cause it was a nightmare.
Sainsburys is aware of the car park being at a stand still at times because of the congested traffic on the main road where is very difficult for someone to give you a chance to exit the car park.
I really need some help and advice as to how should I go about appealing:(. I will not pay for that PCN cause it was not my fault. I also don't ignore any letters. I'm a single mum who tries to make ends meet. Looking forward for a reply.

Start by reading the newbies stickies at the top of the parking tickets and fines board.

Appeal on those grounds, but as the keeper. Refer to the driver as...the driver.

3JD08399 ParkingEye v Ms X. (Altrincham 17/03/2014). Fistral Beach. The defendant spent 31 minutes waiting for a car park space during the crowded holiday season. The ANPR evidence was therefore not relevant as it showed the time in the car park, not the time parked. The judge ruled this was not against the terms and conditions of the signage. The judge also stated that in any case £100 was not likely to be a true pre-estimate of loss.
Also state that the principle of frustration applies as the driver could not leave the car park due to the queue.
Do the ANPR pictures support this? Ie, can you see the queue of other cars?
If the PPC reject the appeal, then its off to POPLA with you for a guaranteed win, but you also need to complain to the BPA, because this practice need to be stamped out.Dedicated to driving up standards in parking0 -

Have you actually asked the Sainsbury manager to get it cancelled because of the congestion? The manager, not a customer services person. Can you show by a receipt or card/bank statement that you were a customer.
This is in parallel with the appeal, of course. In the appeal, you need to emphasise the congestion that the driver informed you of.0 -
I'm going there today to speak with a manager. I do not have any receipt from the store but I do have receipt from the store across from Sainsbury. They can check on their security monitor to see when I enter the store and also when I left. I doubt they would do anything but its worth a try.0

I'm just getting back from speaking to the Manager at Sainsburys about canceling the PCN that was issued on the 22/11/14. He did not even ask for a proof of receipt let alone check the PCN letter. He just call a supervisor to get the pcn number and my registration number so it can be cancel. I make sure I took his name and the supervisor signature if in case it was not cancel. Sainsburys entire staff know how crazy it was on that day where every traffic was at a stand still and yet still allows pcn to be sent out to car register keepers. They should have cancel all pcn for that day. If there was a way I can contact the other drivers who receive pcn for that day to go get they pcn cancel. They would definately cancel it, cause there's always a problem at weekends which they are aware of. I am very happy. Thank you all for the help and advice.:beer::j:rotfl::T:A:D0

In fairness to Sainsbury, they would not be in a position to know who was involves and they have delegated that to the PPC. And the PPC needs to spend £2.50 to find out!
What common sense would tell both parties is that Sainsbury should make the PPC aware of there being a problem and instructing the PPC to block cancel all tickets for that date. It should have been done the day after to save the PPC's costs and some motorists coughing up, Regrettably the mathematics will probably come down on the PPC's side though.0
