TalkMobile Advice Please

I have always stressed to my children the importance about being careful with data usage. The two have gone years without going over their contract allowance.

However, last week my daughter made the mistake of listening to music a few days when walking to and from school. She didn't appreciate that it was streaming the video as well as the music.

This has resulted in an unbilled use of £235.

So no question that she was streaming but I have two niggles.

1 - I was given to believe that I was protected by a £50 limit. When I put that to TalkMobile they say that it can take 48 hours to register the use. This makes the limit practically useless, and to be honest I question whether this really is a limitation - it seems a convenient way for them to make a lot of money.

2 - I'm also not sure about their recorded numbers. They record usage in blocks of 2.93MB. Between 08:02:06 and 08:29:33 they say she used 597 blocks or 1749MB. Over 1647 seconds this is a download speed of 1.06 MBps or 8.50 Mbps. This seems very fast for 3G. Does this sound realistic or could they be overstating the usage.

What do you think - is it a lost case or should I be fighting this?

    You have a case only if you can prove that you were 'given to believe'. Read the T&C (as you should have) and you will see that this limit is like a credit card limit, i.e. it protects the company, not the customer.

    According to Wikipedia HSPA, that is a variety (development) of 3g, can do 14.4Mbit/s, not to mention HSPA+.
    What do you think - is it a lost case or should I be fighting this?
