Liverpool CC transfers

Options
Does anybody with legal background know what legal rights the LiP has in cases where there is transfer to Liverpool, or similar? Surely the CC legal system cannot expect hundreds of LiP to travel to hearings hundreds of miles from home, often at their own expense (certainly in time/loss of earnings etc) to attend hearings?
Or will the majority now be dealt with by the judges on a no hearing basis, potentially preventing the Lip and (indeed the airline) from presenting their case fully?
Given the definitive verdict of the CoA and affirmation by the SC, what problems do local District Judges have in holding these hearings. The judge in my case had no difficulty in making the decision, albeit an incorrect one, now proven.

Very good point JP, perhaps they will hear arguments from Bott & Co and the airline, then make a decision affecting all other claimants ex-parte for claims relating to the same flight.

In fact, you never know if it's obviously not an EC, (ie tech fault) then all the cases might be dealt with ex parte, in one big bang of the gavel :jcertainly clear the backlog.

I think the Courts just may have decided on a central strategy to deal with the huge number of cases, if Monarch alone have 900+ cases. How many cases from J2? if you go by thread count, then perhaps a few hundred more stayed for J2 in the region of 1200?

Obviously the same arguments will be put several times over, if all the cases affecting the same flight were heard centrally so taking a decision that will affect every claimant seems sensible.

However, to cut to the chase, I don't know how this could be done fairly, perhaps all claimants would be given the chance to submit written correspondence, then the DJ makes a decision, I don't know, it's obviously fraught with danger, but something has to be done to prevent two barristers in different parts of the Country fighting a claim for the same flight in two different Counties. Can you image the amount of appeals if the outcome was different in both locations, because of the very reasons you've pointed out!
