  • Contact the agent that did the check-out and request an explanation, in writing, as to why this procedure was not carried out correctly, in line with the check in.

    Then call the police because your tenants have stolen your property, take them to court, and teach them right from wrong.
    I can't add up.

    It may be difficult to prove though, as they have a report which clearly shows the items as 'not missing', the police are unlikely to follow this up past an initial enquiry, as the burden of proof is so high.

    Im unsure if the OP has been to court already, for civil proceedings

    I have been to court and won on the basis of those items clearly identified as missing, but those i.e. those I have mentioned could not be claimed for as the check out clerk did not make it clear these were missing.

    Guest101, your comments are nothing but worthless so please don't bother replying. My initial question is quite clear and asks where do I stand re legal recourse where the check out agent is concerned, so perhaps trying reading before you type.

    What has the "agent" said in response to your questioning of why the check out was not conducted correctly in your view?

    Have they denied an error, i.e. the furniture was there when they check?

    I think the point was highlighting that your case against the tenants is finished.

    Do you have a case against the agent who did the check in and check out - possibly.

    If you can prove negligence, which led to a loss. How much do you think you have 'lost'?

    not quite sure how my comment was worthless. I asked you whether you wanted to sue the agent?

    You need to quanitify the loss and issue a letter before action. BUT it should be worth noting that your contract may say something along the lines of: the LL is responsible for checking the accuracy of this report
