  • the claims process should continue on as though nothing has happened. The basic law of contract did not change with the OFT stating about a test case.

  • I am acting on behalf of my parents as they are not computer/internet literate and i have been an avid subscriber of Mr Lewis's since before the Bank Charges situation arose.

    This also has been a bugbear of mine for a long time as i always had the feeling that banks were charging an extortionate amount for the actual deed's carried out.

    I have got to the stage of filing with the court, this was done 25/7/07!!,(£120) i am now wondering what the situation is and where do my parents stand, as far as i see it nothing has changed and i will press on until the legal arguments become too much stacked against me, i believe that what i have done is right and just and my parents and i agree that the banks have to charge fee's we do not agree that the charges should be so high.

    I would like to know if there is any finite step by step procedures now that the claim is in the system? i see that the 14 day option is still enforced but i would like to know what if any effect the impending "Test Case" will have on claims so far into the system and i will fight with every sinew in my body to try and make sure the Lloyds TSB do not win.

    Maybe. But for many of us, having to wait maybe years isn't a nice prospect. I could do with the money they helped themselves greedily to, right now - not in a few years time.
    They will appeal and it will go on for years, which is good for cases stayed as s.69 8% daily interest will add up over those years.
  • As many of us have been put into financial hardship by these charges and no doubt like me others have got their case going via local court i have one question at this time.

    1. What provision is their for cases of claimants in financial hardship who are going through court, will these be heard? :confused::confused:

    I think me and natweststaffmember are in possible disagreement over whether the courts will stay pending cases. I have noticed from a couple of posts that some courts have lost patience with the courts because of the pracice of filing defences and then settling at the court. Therefore if you were to oppose an application for a stay on the basis of the hardship it would cause and that it is just delaying tactics by the banks the court may not agree to suspending your case pending the test case.

    The only question is whether the Master of the Rolls or the Lord Chief Justice who both go off on thier summer holidays on wednesday would give a direction suspending all bank charges cases pending the result of the test case. On checking the Court Service website earlier today there was no Press Notice to the effect that they have.

    It's all speculation at the moment, really. I'm sure Martin and MSE will be pursuing answers to all our questions.
    Apologies if I have stirred the pot in any way with my pessimism - it's just all been a blow even though in the long term we will probably all benefit from having the whole issue of charges examined.

  • My bank made me a partial offer last week, i have 30 days to decide whether or not to accept, will i still be entitled to this if i sign the contract they have posted me because it is in writing or can they now withdraw that offer because of the test case, confused on what to do because i could take the partial offer and run but what if the consumer wins and im entitled to my full amount....

    Please Help

    All offers are being honoured, but its your choice if to accept it, or take the risk.

    The advantage of making a claim is that you do not run into the limitation argument. Therefore to protect yourself I would issue as then it can not be later claimed that you are statute barred.
