as an aside, if the trust is the PPC and is a member of the BPA, complain to s clark at the BPA that the trust has not followed NTK protocols and give him copies of the NTK and your appeal to those named on it, plus their reply
plus you have not had a decision and popla code within the 35 days
see what he comes back with because the appeal was in the timeframe and its not your problem if they dont follow the CoP
you could also add in your trust complaint that you have copied in the BPA too0 -
Firstly, I wouldn't bother entertaining the debt collectors, just write to them telling them that all debt is denied and that they should return the file to the hospital. Any further contact from them will be considered harassment, which is a criminal offence.
Secondly, if that is the correct parking policy for the Hospital above, it states:
Parking Enforcement and Appeals. In order to manage and control its parking operation the Trust does take enforcement measures through the use of Parking Charge Notices where vehicles are observed parked in non compliance with the parking rules. There is an appeal process built into the penalty system if recipients feel they have been unfairly treated. Details on how to use the appeal process are explained on the Parking Charge Notice. See Appendix 4
I would FOI the hospital for a copy of their GPEOL also.0 -
How much is the Parking Charge? You state in post 1 that it was £20, if paid within 14 days, however, again that parking policy states:
The PCN carries a charge of £30 but this is reduced to £15 provided payment is received by the 14 day from issue. From the 15th day of issue the charge rises to £30 and must be received by the 28th day from issue. If no payment has been received by this time the PCN will be forwarded to the agent who acts for the Trust and they will take over the enforcement of outstanding charges. The Trust will not issue any further reminders once the original PCN has been issued.
So if correct, they are not even following their own parking policy.0 -
It was £20 rising to £40. It was £54 on the NTK. I'm pretty sure the document above would have been superseded as it talks about pay and display but it can't hurt to ask.0

Yep, FOI the hospital for their GPEOL and Parking Policy, although the Parking Policy should be a public document. And as I have found out with my case never assume anything where the Hospital concerned...
The contract the hospital has in my case talks about clamping and that has not been superseded no matter what they try and tell me.0 -
I thought your relative worked at the hospital? Should be easy enough for them to find the people who handle such things.
Personally I'd email the Chief Executive, Stuart Bain (stuart.bain@nhs.net) and it will get passed on.
Are you sure this is the correct email address. Usually all NHS email addresses are **@(the trust name abbreviated).nhs.uk

In all my correspondence with the Trust, every email address has been:
firstname.surname@nhs.net
or one person had (must be more than one person with that name):

Just added the suggested parts to the end of my email.Further to this, I think its disgusting that you would treat your hard working staff in this manner. They already pay an extortionate amount of money to use the car park, only to have the trust try and levy these charges against them when they have done nothing wrong. The ticketers in the car park are employed now solely employed to catch out staff as the public car park is now pay on foot and thus they are not needed in this car park.
The contact details for the parking department are deliberately hidden to avoid challenges in the hope people will just pay up and move on. This is in breach of the guidelines issued and therefore I will be contacting the BPA, of which you are a member, to complain about your conduct.
I will also be writing to Damian Green MP and also the MP's for Dover, Folkestone, Canterbury and Margate to inform them of the trusts disgusting behaviour. I will also be contacting Kent Messenger as I know they have taken an interest in hospital staff parking in recent months.
I would like confirmation that this charge is cancelled as soon as possible and would also ask that you request that PCN Parking Solutions cease contact with me on this matter as any further contact from them will be deemed as harassment and I will take the appropriate measures.
In addition to this I would like the trust to supply me with the following information under the Freedom of Information Act.
1. A copy of the trusts Parking Policy
2. Your Genuine Pre Estimate of Loss, which would have been used to determine the cost of this charge.
I appreciate that you're a busy man however if the correct contact details were supplied to me I wouldn't have felt compelled to bother you with this matter.

also , possibly ask how they plan to implement all the new guidelines issued by Jeremy Hunt as detailed in his statement last august too (because his guidelines are supposed to relieve staff parking issues and public parking issues too)0
