    DEAL have been known to tell people the claim has been dropped but then "forget" to tell the court. If they don't tell the court it's actually still live. If you are told it's discontinued check with the court. Unless the court tells you not to go make sure you turn up.

    Hi all

    Received a letter from DEAL today advising that they have discontinued the claim against me (with a N279 Notice of Discontinuance enclosed).

    Taking into consideration the advice from waamo above - I'll give the court a call tomorrow to check that this has been filed with them.

    Job done it seems... I'll have a go at trying to claim expenses and let you know how it pans out.

    excellent, but actually go to the court unless the court tell you its cancelled, take no chances , plus have your expenses prepared and printed too

    All the others have been fake and attempts to get people not to turn up.

    Hi all


    Just thought I'd give you an update.


    I went to the small claims court as per the appointment I'd received from the Court yesterday. Turns out DEAL/CEL have discontinued the case against me (but as pointed out above - best for me to turn up as I hadn't received anything from the Court to confirm this).


    I've submitted a letter to the Court asking for them to award my expenses on the grounds that DEAL/CEL have acted unreasonably in bringing the case in the first instance (and that they discontinued action only two days before the hearing, despite having had my defence for some months now).


    Will let you know what comes of it.


    Finally - thanks to everyone who has helped... particularly Coupon-Mad and BlueToffee for the excellent defence statement that I was able to make use of).

  • Well done great result - exactly the same as happened in my case.

    Hope you manage to hit them in the pocket. I'm still waiting to hear from the court regarding costs but fingers crossed

    I turned up in person... They didn't have any record of the hearing. Im guessing that because DEAL pulled out only a couple of days before there wasn't enough time for the court to write to me (which I'm hoping will help to demonstrate how unreasonable they have been).
