O2 mis-selling?

I purchased an upgrade earlier today, i felt obgliged to do so, and was informed, 'it's the best deal around ATM'.
When I returned home I found the same phone and allowance a lot cheaper with the same company O2,
I paid £100 for the phone and the monthly amount is £42. Online it is £29.99'fir the phone and £33/month, a lot cheaper,
I returned to the store, after checking online that I could return the phone, to be told that I couldn't return it for any reason as I'd fast tracked my upgrade!
I spent ages on the phone to O2 and still I'm non the wiser, as keep being given conflicting information!
Can I or can't I return the phone and cancel the contract?!
Or can they change it so it's equal to the deal I found online?!
Not happy at all, and O2 are saying it isn't mis-selling!?

    It isn't mis-selling, you heard what you wanted to hear, the sales person wouldn't be aware of all the deals, the best deal meant what they were offering you.
    There is no cooling off period for upgrades.
    Also the figures you show are they for the same airtime allowance?
    Check twice buy once is the order of the day.

    I'm so angry with myself, I'd usually pre-check online, but full of cold ATM and didn't have the time, no excuse I know, but you listen to what they say and believe them!

    Well, there is no statutory cooling off period, but I don't see O2 return policy excluding either upgrades or in-store purchases:

    Do I get a cooling off period with my upgrade?

    You have 7 working days to return the phone, however if your previous tariff has been withdrawn you won't be able to move back onto it. You'll stay on your new up to date tariff.If you choose to change your deal then you will need to return the phone to us and once we have it back we can arrange your new deal because this may have an effect on how long it will be before you can upgrade again.

    If you've returned your phone in the cooling off period and chosen another one, the cooling off period doesn't apply to the new phone.
    I think the shop's salesman is pulling a fast one - hardly a surprise given the commission he loses. This is providing that the 'store' was O2, not, say, CPW.

    What 14 days? 14 days is for new contracts, not upgrades.

    Does this mean that you paid extra for getting fewer rights? If so, you seem to have been really desperate to waste your money.

    I paid £20 to upgrade early, didn't seem over the top,
    So should have waited,
    Really angry with myself!
  • If they've said on the receipt 14 days but upgrades should be 7, does it invalidate the contract?
  • Apparently 7 days is online, it's 14 in store!
