Mobile stolen in transit back to 02

My BF received a free upgrade, decided it didn't do what 02 said it would and sent it back using prepaid address label. It's gone MISSING!! Has no proof of posting (was in a hurry) and 02 are demanding payment of £300 odd for it as they haven't had it back.
What can we do?
£16,500 in debt.
New debt free date: 2015 (was 2046!!).
Thanks MSE for helping me budget and therefore increase payments from £30 per month to £150

    doubt u can do much. u must ALWAYS send fully insured via next day special delivery. most companies make this clear on their websites.

    Only thing you can do is go to the post office where you posted it from and see if the person you gave it to is there and ask them if they remember you posting it etc and then ask them for proof of posting etc.

    (I know it's a bit late but i always send stuff back as recorded delivery,its only 70p as postage is already paid for abd then they can't deny receiving it back as they get 100,s if not 1000's back a day)

    Thanks for replying so quickly.
    The daft thing is my BF has his own business- always sends stuff recorded del. Time was tight and post van (in village) was waiting to go.. ho hum.
    I am sure they can't MAKE us pay (we are cash strapped, hence finding this site). Surely the onus is on them in the spirit of English (and Welsh) law to prove we haven't stolen product?

    That was BF option as he saw it - but a long shot. Still worth trying every avenue I suppose. Heck, (how polite!) we are so careful but don't you find tha something comes along to bite you in the b@m!

    It's hard to say but i would get the person in the post office to make a note of me posting the parcel etc as if push comes to shove and they do want the money for it,it will be hard for you to prove you posted it etc and hard to prove they had it back or it was stolen on the way back or if someone had it who works in the returns dept and looks for parcels such as yours with no proof of postage etc.

    in reality it was your responsibility to ensure that the phone got to the company, the it got lost in the post however genuine will not hold any water, i would prefer to have to foot the bill yourself and try the above other than that i cant see the company footing the bill

  • Just a small but very important point:
    DO NOT send phones through the post using RECORDED delivery. Its has no form of tracking on it and they will only rebate you about £29 if it goes missing.
    DO use SPECIAL DELIVERY which is tracked and insured up to £500.

    I discovered the difference to my cost when sending a phone to a relative. I wish I'd noted the IMEI before I sent it so at least I could have had it blocked. Bloody thieves...

    Sending a phone back to the company you have had it off using recorded delivery is fine(and the cheapest way of doing it)All you have to have is proof of posting.I have had a few phones go missing over the years the same way as yours went missing (Bloody thieves too :() but thats for o2 and the post office to sort out,i faxed the proof of posting over to o2 and never heard another thing.
    Sending private post is totally different and i too would recommend special delivery normally parcelforce 48hr delivery etc.
