Consumer rights if product brought as a business

Hi All,

Hope you can assist me on this, in 2012 I purchased a macbook pro (but not apple care) I use the machine everyday as I am a designer, over the last 6 months I have had problems with the screen, a ghosting issue, dead pixels and some of the coating has come off. I have contacted the place I brought it from and a few others a while ago to get quotes for repairing / replacing the screen and as it is out of the manufacturers warranty the costs were £500-£600 which I can't really afford.

I then heard about the 6 years consumers right act, so thought I would contact the company I brought it from, but they have just told me that as I brought it under my company name and not my own name consumer rights do not apply, could some one clarify this?

Think about it for a minute, why would a business be granted consumer rights?

You would have to take legal advice and use the courts to reclaim any damages you have faced.

Thats what they basically told me, so I haven't any rights as I purchased it under my business name, guess I was just grasping at straws.

You have the 'right' to take them to court if you can prove the damages you have suffered are their fault.

Next time I purchase a laptop I will put it in my name instead - a very expensive lesson to learn.

I dont think I really stand a chance taking apple to court.

Oh... did you buy direct from Apple?

Your contract, and thus any breach, is with whoever sold the thing to you.

If I were you I'd check what the part costs are if you buy yourself.
I'm sure it will be much cheaper.

Probably not amazingly similar, but I fixed my other-half's iPhone screen for £12 so you might only be looking at £40-£50 or so.
If you don't feel confident doing it yourself, what about looking for an independent repairer?

Your rights are determined by your contract with the seller.


It doesn't matter how you buy it, your rights are determined by how you use it. So if you use it for business it is a B2B contract.
