Care Parking PCN - The Range St Helens

Hi

I was wondering if someone could help me please. I received a PCN letter, addressed to me today, however, there seems to be a lot of flaws in their letter.

The letter says:

We have issued a Parking Charge Notice (PCN ******) to your vehicle because it was parked in breach of the terms of parking at Chalon Way that we are authorised to manage on the 15th November 2014 at 19:19. The terms and conditions of parking on this private land are clearly set out on the signage installed with the car park. By parking with this car park you are bound to these terms and conditions and liable to pay a charge if you breach these terms and conditions.

The rest of the letter is the usual wordage about the fine £100 or £60 should I pay within 14 days (now 9 days as only just received the letter), whether the car was stolen etc.


The thing is, I didn't notice any signs entering the car park, however, Chalon Way have 3 or 4 different car parking areas, not just the one, and it is not stating the range car park.

The pictures provided do not show me entering or leaving the car park, nor dates or times, it shows the car heading one way on the road near the car park, and then heading the other way on the same road near the car park.

The car park wasn't full or anywhere near full and was practically empty when we left. The duration I was there was 2hrs 42 mins.

So basically, what should my next steps be?

All advice will be gratefully received.

  • Thanks I have read that, but I am still confused, mainly as it has been addressed to me and not the registered keeper/driver and because their claims are very vague.

    How did they acquire your name and address if you're not the RK? Have you ever been the RK of the vehicle?

    It says 'We have required your details from DVLA as the registered keeper of the vehicle, through the Reasonable Cause of pursuing an outstanding parking charge. The reason we issued a PCN to the vehicle is as follows: Exceeded Maximum Stay Penalty.

    Admission that the charge is a penalty??? Gold dust for your no GPEOL appeal

  • Just went back to the newbie sticky to see what the GPEOL is, so basically, cos they have put it's a penalty, they have no grounds as it's not stating any loss made? Is that right??

    Sorry, I only knew the basics about the parking fines, but never had one, so am completely new to this.

    If you're not the RK I still don't understand how they've got your name from the DVLA. If you are not the RK, have you previously owned the car?

    Well, it's back to the NEWBIES FAQ sticky and use the initial appeal - as is - don't try telling your story in it, you might just reveal who the driver was - DO NOT reveal any detail about who was driving.

    Did their letter to you literally contain the word 'PENALTY'?
