Small Claims Court Claim

My wife and her 5 friends were delayed more than 5 hours on a 4 day trip.
Jet2 confirmed it was a technical fault and so compensation is due.
I am in the process of filling in form N1. Is it ok for ME to make the claim on behalf of my wife and her friends as long as I get a signed letter from them all saying they are happy for me to represent them.
There is no way my wife (the lead name) would be happy standing up in court.
regards
also, when calculating interest is it simple or compound?

Hi Stevemej123,
First of all you know this should be in the J2 thread - please don't bite my head off - just pointing it out
If your wife is the lead name, then I wouldn't advise you try and claim on her behalf. I trust your wife booked for the entire group? If that is the case then, with Jet2 I would suggest you issue N1 and list the individuals as joint claimants. Otherwise J2 will be quoting 'locus standi' at you.
If you did not go as a group on 1 booking then each of you would have to make individual claims.
Re-assure your wife, that she should not need to be in court for some time, perhaps not at all - this is very early on in proceedings so let's not start jumping the gun. But if your wife really feels fear of entering into Court proceedings there's always a good NWNF solicitor that will help.
EDIT - You've got me on the interest question - I don't know the answer to that one. After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

Thanks for your reply - This is a general question about making a claim so using the governments form N1 for small claims so I don't think it's necessary to put it in the J2 thread.
It was a group booking and my wife made it on behalf of her friends. ok I will write the claim in the first tense as if my wife were writing it. If we end up going to court I'll just go with her and speak on her behalf.
What does anyone think about how to calculate interest (simple or compound). Also, do you just convert the euros to £ with a web rate on the day of the hearing?0 -

1 Fair enough
2 I'm not saying that it would not be possible for you to represent your wife, but don't forget that J2 will jump on this and try and make an issue out of it, where there isn't one.
3 Still stuck on the interest question, but when to calculate the rate of exchange is still very much a divided one. Vauban posted about this the other day, yes you can do as you suggest but you can't issue proceedings in the Euro currency. You can use the date you start Court proceedings, that seems to hold favour at the moment., but you can also use the date of the delayed flight - I'd use whichever gives you the best outcome. After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I just found the answer on the governments website :
To calculate this, use the steps below.- Work out the yearly interest: take the amount you’re claiming and multiply it by 0.08 (ie 8%).
- Work out the daily interest: divide your yearly interest from step 1 by 365 (the number of days in a year).
- Work out the total amount of interest: multiply the daily interest from step 2 by the number of days the debt has been overdue.

Yes. This is all also on the helpful thread, Taking The Airlines To Court (plus more! ). Unfortunately this has got buried by new threads.0

Thanks Vauban, I knew you'd know the answer - That's a thread I've missed myself, so looks like I have a bit of reading literature tonight! After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

I think most of it was in fact incorporated into the guide, so there shouldn't be any surprises. But let me know if there are!0

Just a couple of lighter things from my hearings. Firstly my wife insisted on going with me - I think she was worried when she saw me packing the boxing gloves in my briefcase as she knew I had no time or respect for Monarch. Secondly upon entering the court room the barrister for Monarch informed my wife that the Judge should be referred to as 'Sir' - her response "I have never called a man sir in my life so I'm not going to start now" and thirdly we sat through the whole procedure.
Finally I am grateful she went with me otherwise I think the lying barrister would still be unconscious (the case was 2 years ago!) as she held me back!
We happened to bump into him at the train station on the way home - I muttered something about the English education system obviously leaving a lot to be desired and left it at that.0 -

hmmm, I could do with a wife like that, and they say 'women are the weaker sex?' Far from it!!
Steve, I would be thankful that your wife was the lead passenger and made the booking! After reading PtL Vaubans Guide , please don't desert us, hang around and help others!
