Technical oversight - were we in the wrong?

  • Can you confirm if you've been asked to pay the initial fitting fee as well as the new reduced fitting fee?

The last time we had a hole needing filled their surveyor came and measured the hole, showed how the frame would sit in the hole and listed all the specs so any errors would be down to them.
  • Indeed, we payed the initial installation cost. Now as the cill was incorrect and they had to abandon the install they want a further payment at the slightly reduced rate. Their argument being that we signed for the 85mm cill on the initial quote and agreed to their technical drawings

Our point is that we didn't choose the 85mm cill and being a non trade professional, we weren't to know that for the door to be correctly fitted, it should be located over the cavity wall closure.

I'm concerned that we could push things further but we still need the correct 150 cill and our door fitted, neither of which I would imagine they'll be forth coming in providing should we take legal action against them.

This was never offered to us at any point during the process. In fact no advise was given. But also none was asked for by us as we had no reason to question the technical details other than the measurements of the frame.

i presume this was all done online then
  • There is no reason why you can't pay for the fitting of the door with the correct cill and then chase the supplier for a refund afterwards.
If you initially paid via a credit card (either full payment or just a deposit), you would also be eligible to try a "Section 75" claim.
As halibut pointed out, their website states that they will recommend the best specification for the job in hand, something that they don't appear to have done.
  • If we agreed to their free cill and reduced fitting cost wouldn't that count as accepting a settlement and stop us from taking it further?

It was done via BACS as CC would have had associated costs. Give of hindsight eh?
  • This appears to be the full quotation in which the above appears

"If it's a FunkyFront door you're after, why not use our door design tool on the website and send it through directly to our estimating team.

From there our estimating team will produce a quote and a dedicated sales person will be assigned to your project. The sales person will email your quotation and be on hand to answer any questions or queries you may have.

Your ******* quotation has a unique reference number which means any sales person at ******* can access your project details. Due to the way we invest in the training of our team there's no hard sell or pressure, our sales team do not work on commission which means we have an honest and informative approach to selling.

We aim to furnish you with as much relevant technical information as possible in a simple and sensible way to enable you to understand each products benefits. We will always recommend the specification that best fits your project."
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Yes there is.

You will not have a leg to stand on if you have agreed to pay the new reduced fitting fee in addition to the original fitting fee.

If the OP wants to challenge the charges then he needs to do it before the work is done. Either by negotiation, or by getting another person to fit the door and claiming from the original supplier for that cost.
