PLEASE HELP!!! - PAYPAL & My Rights?!...


Hi All
I really need some urgent help pleeeaasse!...:(
I sold my Iphone 6 (an upgrade) as urgently needed the £, on Ebay.
Received Ebay message from buyer saying payment will clear in 24hrs and could she collect phone from my house and take my mobile number and address to arrange.
I gave her both my mobile number & address and said once the £ has cleared she could come and collect, no probs.
48 hrs later the money finally cleared in my PP a/c. I received an update from PP saying I am safe to send the phone.
The girl text me to say her work have called her back home to Glasgow so she could no longer collect in person. She asked that I send the phone to her work address instead as she needs it ASAP.
As I'd received the £ in my a/c I didn't think twice and so sent it to the address she'd asked me to, special delivery.
The following day the phone was signed for and received by her.
A day later I went to transfer the £ into my bank account only to see THE MONEY HAS GONE!! Paypal has reversed the payment, I couldn't believe it.:mad:
How can PP be allowed to simply take the £ back out of my a/c after it has cleared? How can this be right?
Contacted PP and they informed me the buyer was using a stolen credit card but not to worry I should get £ credited back in a few days as covered by sellers guarantee.
5 days later, still no £ in my a/c and gone o/d so desperate now.
Called PP again to find out why no refund. They said that because I had sent phone to a different address (not the address registered on her PP a/c) then PP do not cover this within the sellers guarantee. :mad:
Called Ebay, they have already suspended her a/c and told me to call Action Fraud, nothing more they can do.
Called Action Fraud who gave me a Crime Ref No. but said the hope of getting my £ back is pretty much zero.
So now I'm short of £500 which is a lot of £ for me and my bby and I'm in desperate need of it, but it seems neither Ebay, PP, Royal Mail or the Police can do anything to get my £ back.
Can anyone out there tell me whether I have any rights or come back or is there anything in the world I can do to get my £ back???

    It is pretty clear that to be covered you have to send to the registered address with proof of delivery.

    I would only take cash in your situation.

    I feel really sorry for you OP as you are clearly the victim of a scam. It is also clear however that you are not covered by any guarantee from PayPal as you have broken their terms and conditions.

    Unfortunately you gave up your seller protection the moment you sent to the wrong address. Paypal are quite clear that for seller protection you must send to the address they give you.

    This is a commonly tried scam, especially for phones, luckily the scammers rarely find anyone to fall for it anymore as it is so well known, unfortunately you were unlucky enough not to be aware.

    At least you have an address, you could try doing searches on that address and seeing if anything turns up, name wise, as if you can find out who took delivery of the phone you stand an outside chance of using small claims against them. You could even try an official letter to the address explaining that you will be involving the police as you have proof that the phone arrived safely with them, and you therefore want either the money or your phone back.

  • Your rights are to sue the person that bought the phone from you but if they are willing to use stolen credit card details you are probably throwing good money after bad.

    By sending to an unverified address you lost you seller protection

    Incidentally, although there is mroe than one type of paypal email now this is what they say at the top, and which you failed to follow:

    This item is eligible for Seller Protection.

    Don't forget to:
    Send the item to the delivery address below within 7 days.
    Please note: items delivered in person or to a different address are not covered by Seller Protection.
    Use a trackable proof of delivery.

    whilst you are searching on the address, make sure you also take screen grabs of everything to do with this transaction- including the original ebay selling page etc.

    Op I agree with the other posters.. you lost any protection when you sent the phone to the unverified address... Have you done any digging into the address you sent the phone too? Unfortunately this is a common scam and the scum get away with leaving their victims defenceless.

    Paypal's BASIC rule is only to send to an address that Paypal says it is OK to send to...

    As you have broken this rule, then Paypal cannot help you.

    The only thing you can do is involve the police (giving them the address, phone number etc...), but it is unlikely you will see any of the money again, nor the phone.

    I suspect most people will get as far as reading "I sold my iphone on ebay..." and immediately guess you have sent it to an unconfirmed address and it was a scam.

    Sorry you got scammed, but when using PayPal, it's really important to abide by their rules...

    ps - if you had allowed them to collect, you would have had the same issue. They might have suggested this to see if you were clued up on Paypal rules.

    Have you informed the police that the item was signed for and sent special delivery?
    The fact that someone was at an address and took receipt of it suggests there is a very slim chance of getting somewhere. You also have a mobile number from the text that was sent. You may be dealing with a chancer who has left a trail, unfortunately, if you're dealing with experienced criminals there isn't much hope. Your best hope is to follow up police enquiries and ask them to investigate properly rather than fob you off with a crime number. You'll need to write to a Chief Constable, I think it would be your local one initially but can't recall how that process works properly.

    You could also try getting in touch with Rory Cellan-Jones at the BBC who posted about a scam that was tried on him on Ebay when he sold a phone http://www.bbc.co.uk/news/technology-30079063
