Word of warning people stay away from DFS

Hi
I had a sofa delivered with several faults
I realise now I shouldn't have let the guy leave the sofa however I wasn't thinking straight.
Originally I'd have been happy with a replacement however now i never want to deal with this these people. I rang them straight away to be told their repair guy needs to come out when I had told them not a chance I paid for a brand new sofa not a faulty one if I wanted ex showroom or used I'd have went to a charity shop!!!
They insisted he had to come out and that was the prcocess basically made me waste 2 weeks by the time I managed to get a manager on the phone who never returned my calls for weeks. Only to be told no its a repair and I had no other option! !*
I hung up on the guy who I will name and shame Brian and Tony Kerr from West of Scotland Tollcross store. Left several messages with Claire and Emma also*
So far only the finance company seem to be the professional ones who are dealing with my compaint now. However they tell me the 14 day cooling off period has ended and onky dfs can cancel however I stand by my claim item arrived faulty not as described and I want it uplifted and agreement cancelled. Originally I'd have asked for a replacement however their so called repair guy Martin told my wife your better getting a repair as a replacement sofa could be worse !!!!*
I also wanted to ask the more knowledgeable folk on here am I within my rights to ask for the sofa to be returned and credit cancelled?

By the sounds of it you have never accepted the goods in which case you can reject it under the sales of goods act and have a full refund.0 -
I did sign for them but wrote faulty on the sheet of paper, reason for this was the guy said he couldn't take it back and if i contact dfs they would pick it up and replace it.. however that was alot of crap0

The Sale of Goods Act 1979 or
Credit consumer act section 75 ?

Contact the retailer first using SOGA. If they won't provide the necessary remedy then contact the credit provider using S75.
You're always expected to give the retailer an opportunity to remedy a situation. It seems you've already done this so contact the credit provider.0 -
If you try to get a refund directly under the SOGA, this means you will have to convince DFS to back down and give your money, something that doesn't look too likely at present.
You can contact your credit supplier, informing them of the problem and state that you want to make a S75 Consumer credit act claim for faulty goods that you have not accepted.
They may well try to fob you off by saying that you should attempt to claim from DFS first but this isn't the case as the credit provider has equal liability with the supplier of the goods and you have the choice as who to pursue your claim with.0 -

You're always expected to give the retailer an opportunity to remedy a situation.
As stated above by SFA, due to the liability being shared equally between retailer and credit company, there is no requirement to give the retailer the opportunity to provide a remedy before approaching the credit company.
The credit supplier may well state otherwise, but they only do this to try to save their own time any money.0 -
Section 75 is not and/or thing.
Section 75 makes the credit provider equally liable for performance of the contract subject to implied terms under SOGA.
Your claim is based on breach of contract and the credit company can be forced to payout for the remedy as a form of protection.0
