  • who cares! you pay it then, I never asked I wanted it! I do have a clue.. it is contractual, and therefore non enforceable and only administrable and not criminal law. You better look at your council tax bill, I am sure it says service`s, who picks up your rubbish, cuts communal grass and supplies the plod, and streetlights? local authority services?

    Council Tax isn't to fund specific services - it's a tax to collect money for the council out of which the council then use the collected money to help fund any statutory & non statutory services.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    And your point is what? it is just a Tax, what ever you butter it up to be. Its a Tax collected on YOU! I ask you this, if the tax was about the residential property, then why is not collected from the owner only?.... exactly!




    And of council tax is `contractual`. And when authority says you owe this, not under common law!

    says CT liability depends on residency. If it's your main home you are liable, if not you aren't.


    Para 14 of another decision mentions absence abroad:

    and says you can be liable whilst away.


    The OP was, as a matter of fact, not resident - so not liable to pay CT to the council, though they may be liable to the landlord if they have paid the CT on their behalf, which would be a civil matter.

    You do know that the vast, vast majority of Magna Carta no longer forms part of British law, yes? The 1215 Magna Carta isn't even the definitive one, and was repealed and re-written several times over succeeding years. The 1215 original didn't even get fully distributed across the nation before it was superceded.

    Because, legally, a tenant takes priority over an owner in the ladder of who is responsible for paying it.

    If you think the council tax is not based on residential property, then perhaps you could explain the basis on which it IS levied?
    And of council tax is `contractual`.

    As is the tenancy you care so little about.

    A tiny political pressure group of reality-deniers bordering on Freemen on the Land...

    If they think that the currently-applicable legal constitution of the United Kingdom of Great Britain and Northern Ireland is not "unwritten", perhaps they could be so kind as to provide a link to the authoritative, definitive text?

    CT has nothing to do with property ownership. It's charged to the occupier, be they tenant or owner-occupier. So as the tenant, you are liable, not your housing association or landlord.
    You are welcome to your half-baked opinions about Magna Carta, but they won't alter the reality of the legislation as it currently stands.
