Council Tax liability whilst Living abroad

Hi, Hello to every one. I could do with some advice, It is about getting charged for council tax whilst being abroad working. I have a liability order from the 1st April to June 2014. I am a Brit, and lived and worked in Asia.


I was a tenant with a housing association, and left quickly to catch a flight to work for 12 months +. My council tax was all up to date to the 1st April 2014, I flew out of the UK on march 26th 2014. I had no intension to come back, and not live in the UK for quite a while. But, I had to come back for personal reasons on the 18th August 2014.


Now back in the UK, living with friends for a while received a Council tax liability order notice for my old address. The order was made in a magistrates court in august 2014, when I was still working and living in Asia. I couldn't defend my self, being along way away, or even knowing.


It looks like the housing association never received my letter of ending the tenancy, and then informed council tax. So now liable for the 1st April 2014 to June 2014.


I would like to know, if I am liable by statute law. Meaning what ever the landlord says, and inform council tax dept. That my residence ended, via passport dates etc, and had no intention of returning to the address, that there is no case for liability.

    If the tenancy was not ended, then as tenant you are liable for CT.

    If you (properly) ended the tenancy and can prove this, you are not.

    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

    I worked abroad for two years and was still liable for council tax. C'est la vie. :(
  • Thanks people, so the housing landlord calls the shots? even although proof of residence at another address out side of the country proves another residence.


    Tenancy really should not be used as evidence of residence with in the UK, any one could say it. How about statute law on liability? I be very curious if there is a point in law to answer.


    I could of have been arrested at the airport, if say it was like two years had elapsed. wonder how far down the road this goes I wonder.


    paying for Ct when abroad, I used Asian refuse collections. and street lighting, and local Asian plod, pavements, services, ahhh I forgot, its free there!.

    Did you tell the Council you had ended the tenancy?

  • Looks like I owe everything to every body, never seen so many hands reaching into my pockets on return to ole blighty. My council tax was pay`ed up to the 1st April 14, I left before it. No need to tell any one, why? Not in the country, my passport tells every body, Hey I left the country on a one way ticket. I am not the owner of the property, do as you wish. And yes, rent wasn't in arrear when I left.


    Yup, Sounds like I owe rent. On a noticeable note tho, the tenancy was ended with out me, does that mean I can some how get it back? sort of like saying if I owe anything, then onus is still with the property? and you made me homeless.


    If I can prove, sole residency was not at the property, from a date, Flight. Visa, and residence permit, to another country, all then that is needed.


    So where is the legislation on sole residency regarding council tax liability.

    If you end a tenancy in the future, I advise you to check that the other party knows about it.
