There is nothing they can do.

They can't record a default or any more information on your credit reports if the original has dropped off. The ambiguous phrasing suggesting they could is just standard wording and anything reported cannot or should never actually show.

Be very careful here though. Should an agreement later surface the creditor may go for a CCJ (which they can do as you have been paying them) and you would need to settle that within 30 days to avoid another six years of bad credit data appearing. (Additionally, if you move house make sure you redirect all your post in case a judgement by default appears). However it does seem you may have been successful in getting the rest of this debt written off.

The implication of Wescot's letter is that they have not bought the debt but have been acting on behalf of MBNA. As such, it is quite possible that the debt may be purchased by some debt purchase firm who may be less than up front when trying to enforce it.

Hopefully this will be the end of it though.

It's a standard letter. I've had some with very similar wording.

    Hello again, disco here.

So i've just received a letter from Debt Managers Services Limited in Rotherham regarding the outstanding MBNA debt. It would appear Wescot have passed this over to them now.

It provides details of the balance outstanding, account number etc, inviting me to contact them to discuss my budget, and whether I'm in a position to make payment. It's then provided me with details of debt charities (step change etc), asking that I contact them if I'm unable to make payments.

I'm tempted to ignore, but would be grateful if you could advise further.

    Many thanks

    Chris

If they keep hassling, and you feel you MUST reply, then point out the previous correspondence and tell them to bog off unless they can comply with the outstanding requests.

Yes ignore. Westcot clearly realised they were flogging a dead horse and sold the unenforceable debt onto another bunch of muppets - Debt Managers Services Limited.

Chuck the letter and any others you may receive in the future in the bin, debt is dead and cannot be re-entered on your credit files. The debt collectors are just chancing it now in the hopes you will pay voluntarily and they haven't just paid ££'s on a debt that won't earn them anything.
