Even if you lost, and paid the amount sued for within 21 days, there's no CCJ to worry about either. But in your shoes, there's all to play for.0

wow i didnt realise!
i remember exactly what I done, as it was the 12th I went into town as it is 5 minutes drive. I parked in Debenhams car park (dont have the car ticket as ticket machine takes this on leaving). I looked in 3 shops looking for phones as my mobile phone was due to end in July. Carphone warehouse, EE, Tmobile specalists.
is the fact that they cannot provide an image of me parking going to tilt the balance in my favour as at the minute it seems to be my word against theirs. I am not exactly a criminal, no criminal convictions, I work in a respectful job helping people with learning difficulties overcome issues and I am very honest. Will this be taken into account?
This is all excellent detail which you can put in your witness statement eventually. The judge will hopefully ask a few questions, realise you are honest, then dismiss the case.
I visited Parking World last week and spoke to some ANPR specialists. My blog today has another few reasons why these cannot be relied on.

If you spoke to anyone at the shops and think they might remember you, go back as soom as you can and see if you can get a statement from them confirming you were there. Even better would be if they would be prepared to give you the CCTV of yourself, but this might be unlikely (unless they have been a victim of parkingeye too)Hi, we’ve approved your signature. Also I rang the court and spoke to customer services who were very helpful. they explained to me that a questionnaire will be sent out regarding the next steps on how I would like to resolve this dispute. The letter will be sent to both parties.
Have you missed the Newbies sticky thread, telling you about what to do when?

And please make your emails stronger - you were told to quote Jeremy Hunt, Secretary of State for Health, talking about Hospital car parks & predatory private firms. You could have Googled it to find his words (still can of course).
Anyway your priority is to acknowledge the claim on MCOL, then work on your defence which must be submitted within 28 days of the court papers arriving (don't wait to hear something!!). Which is why I have given you the link to the sticky thread you missed.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have already submitted my defence to the court, and the reply from Parking eye was sent to me as well as the court where they have refused my defence.

I received a letter from the court last night ''Notice of Proposed Allocation to the Small Claims Track'' a Directions Questionnaire.
I am going into town tomorrow to see If i can get a statement from staff. would it literally be a letter from a staff member I could use? I cant see them wanting to help me by attending court.0 -
Yes - obtain a letter from a staff member.
Also check yr mobile phone for any text message conversations you might have had that indicates where you were.**********************************************

update to this case.
I have received no letter or contact from the court so I assume they are breaking away for Xmas.
I have done a little digging and the grounds parking eye use only cover 2 enterences to the hospital out of 3. I do have images of the entrance without notices and cameras which I did use. Meaning the ''double dip'' will be catching more customers than originally thought and I no doubt believe people will be paying these fees out of fear.0 -

Have you returned your directions questionnaire? If not, you should ASAP.Dedicated to driving up standards in parking0 -
yes was returned same day I received and I opted for mitigation, but unsure as to what Parking Eye will opt for. Playing the waiting game now0

If they are using Beavis as a case example you should object this in the strongest possible terms as county court is not supposed to be swayed by any other case.
To do so gives grounds for automatic appeal as the precedent is not case law, the decision would therefore be technically incorrect in law as it has followed an interpretation as opposed to a definitive case law.
Again this is one area where they are taking the proverbial.
They know people will use template defences and these do not challenge them on recent inclusions hence they are getting away with murder again.
You have to hand it to them, they are clever and cunning.
Always demand your judge hears the case on its own meritsI do Contracts, all day every day.0
