Thank you for all your comments. They were eggs but the bananas were in my fruit bowl before I noticed them for two days. Everything was pointing to the fact it was the poisonous spider and now I am fighting with the results of the shock. They told me that they would investigate it and come back to me with the outcome but they never did. Only the phone call where they said yes it was but the mum would not survive.
Any way I would expect them to acknowledge my complaint and subject access request. I hope it was not that spider, but I do not know.

They could not possibly know the eggs were from that spider from one photo of an egg sack, they all look very similar, they could have been laid by a house spider while the bananas were in the fruit bowl in your own home.

    What is the point?

Do you expect ASDA to send out pest control to every Tom, !!!!!! and Harry who think they have some eggs in their bananas? ASDA are a business not a charity. They have no legal (or moral in my opinion) obligation to send out pest control for something that the customer hasnt even seen.

I would not expect asda to tell a customer they got a product which may at one point in time( who knows when) have had a brazilian wandering spider in it ( which subsequently appears virtually impossible ) , raise the customers fear levels , then ignore her written communications.

They have a responsibility to only give out information that is correct

Then it appears you've been given the wrong information so you can sleep easy now x

They actually said to me that it was that Brazilian spider but mom would not survive. That is why I made a subject access request to get the recording of the conversation. Also they were supposed to conduct investigation to find out what it was and why it was there. They said to the pest control company it was their procedure to do it and they would come back to me. But nothing. I live quite a way from Asda and I spend my time and petrol to travel there, they gave me £1 refund. I was not in the state to argue then.
I understand that it might be just a normal little quite spiders coming out of the sack if I did not notice it in time. But the fact that they did not bother to find out, reply to my complaint, at least aknowladge it. There is still a possibility that it was that bad spider. I had a horrible time because of it, and to be ignored as well just a bit too much. Maybe they need to do a bit more to make sure the customer are aware of what to do in case they find it again. We need to know that the retailers do everything possible to make sure it does not happen but if it does the families KNOW how to act and support and help are available.
I am still going to persue it. I was their customer and they have obligations to treat me with respect and comply with their requirements of health and safety and customer satisfaction. in the same way they expect us to pay for their products and services and do not steal them.

Sorry, but now you're just being silly.

If you have made a subject access request this could possibly explain why the legal department has not responded. It's not unknown for companies to " lose" correspondence for a few months until the piece of data has been deleted, but I'm not even sure the call has been recorded and if it has , where does receiving a copy leave you?
