Dodgy online company nicetap.com: no contact details for cancelling order - help!

in Credit cards
Just over a week ago I bought a tap from nicetap.com and paid £10 for next day delivery (total £135). I am having my bathroom fitted this week and next, but the tap has not yet arrived and the only way of contacting the company that I can find is an email address that no one replies to.
I would like to cancel my order as if the tap does not turn up in the next couple of days (assuming it ever does) it will be useless to me, so I need to buy another one from elsewhere. However, what course of action can I rightfully take?
I know if it never shows that I can claim from my credit card company, but what if it just shows late? I will need to return it and be out of pocket for two lots of postage, which I think might end up being £35. I do not feel it is my fault given that I would not have bought from them had they not offered Next Day Delivery.
Also, how long can I reasonably give a company to deliver before filing a claim?
One more thing. When I click on their Returns Policy I am directed to a photo of a baby! (Was not allowed to include link)
Please help.

Oh dear!, no contact details! You'd be better in the Praise and Vent area below!!!
What no address!! I hope that OP paid on card of credit, noted that it is over £100. DO A CHARGE BACK. That is, if your provider will do so!0 -
You seriously typed your credit card details into that site? :eek:Still rolling rolling rolling......

Dodgy indeed, but their poorly worded and punctuated terms and conditions state:You should normally receive your goods within 1 to 3working days if we have the item/s in stocks, if the item/s you ordered from us out of stock in our warehouse, and we will dispatch your order directly from manufacturer. Please allow 10 to15 working days for delivery!0

Wow that website is a huge red flag about the people you're dealing with. They probably won't be that professional if that's how they present themselves online.
It looks like the tap cost over £100 (I assume?) which means you might have what's called a Section 75 claim (more info from MSE here). Your bank will probably want to raise a chargeback, though, and annoyingly if the merchant provides the tap soon - albeit not "next day" - I think you'd lose the chargeback.
Regarding a Section 75 claim, even though you paid for next day delivery, it might not necessarily be a breach of contract (which you need it to be for a valid claim) unless the contract included a note that "time was of the essence" in relation to the delivery or if it otherwise provides for an entitlement for a refund in the event of late delivery. I've not seen the Ts & Cs of your contract but I honestly don't think this is very likely. That said, I've never heard of a bank kicking up a fuss over £130; it'll cost them more than that to argue about it.
My advice would be to contact your bank immediately and say you want to make a Section 75 claim (just for the record) and then go along with a chargeback if they insist and ironically hope the merchant doesn't provide the tap soon and your chargeback is successful. If you do get the tap, and I'm right about the chargeback failing, you could then press on with a Section 75 claim.
Good luck!0 -
EKM Systems are a company that offer software/services to people who want to build a website easily.
https://www.ekmpowershop.com/
The whois details for the company who registered the site are as follows... Unfortunately it's incomplete...:
The OP could complain to the host, and perhaps get them to shut down the site:
Otherwise, the only way to get any money back would be via the credit/debit card company or bank.0 -
Hmmm... Something suspicious about this site... It could be that on the T&C's is a link to their returns form which just shows a picture of a newborn baby (doll?) with a link going back to their homepage... Me'thinks you've been had!

I would never order from any website that does not have a contact number! Further than that I would ring said number before I even thought about ordering something to check it worked and was kosher!0

Well, don't I feel like a na-na. Have learned a valuable lesson.
Thanks so much for all the advice - I will be following it first thing tomorrow. Cheers.0 -
