Yes I agree. It's theft as far as the law is concerned. Often on here we have a tendency to digress into side issues that are unrelated to the question originally posed.
Obviously this is an emotive issue as well as a fairly complex one.
However this isn't a legal forum. The OP has chosen to post here rather than just go and take private legal advice.
As such people in here are quite entitled to give their viewpoints based on their interpretation of the original post.
If I and others want to digress into side issues, including our opinions on whether it was morally correct to withdraw money, then it's not your business to arbitrate on that.
You're just as entitled to my opinion as I am to yours.
OP condolences to you - if nothing else this should highlight to everyone the importance of having an up to date will.0 -

It isn't that complex an issue. It is theft pure and simple and that fact seems to have been borne out by the willingness of the police to become involved. Anyone who makes it more complicated than that is kidding themselves.

I was not seeking legal advice. My original post was asking what the likeliehood of getting the money back was as I'm fairly sure someone on here has possibly been the subject of something similar. The legal part came up as the discussion continued. Aside from that, I'm in Scotland and as such the legal system is completely different to England ( someone mentioned CPS which we don't have ) so I wouldn't come here seeking legal advice in the first place.0 -

This shows the importance of sorting out your financial position on a regular basis:-
1. Dissolving joint accounts when relationship dissolved
2. Updating Wills (beneficiaries, executor & trustees)
3. Keeping your financial records and pass words secure
4.Talk openly to your beneficiaries about your wishes and how you want your estate dissolved
Tips on executing an estate- do it yourself (don't pay a solicitor), purchase FT on day of death, purchase as many death certificates as accounts/investments/life insurances as the deceased has when you register the death (costs twice as much after the initial registration) and all the Co's want original and recycling 1 prolongs the process.Debt is a symptom, solve the problem.0 -

Well yes, but that's the situation in a perfect world. It's not a perfect world and it wont be so anytime soon. Hence people run into problems.0 -
