A false hope for the OP, I'm afraid.

Yes, I expect you're right about that. Halifax must have told the CMC that money has been sent out, mustn't they. Otherwise how would they know?
Are the words 'I have a cunning plan' marching with ill-deserved confidence in the direction of this conversation?

They just sent the initial form
That really is all a claims company has to do once a contract has been signed by the customer. They put a stamp on the envelope containing the complaint and charge around 30% of any redress (plus VAT) for doing so.

It really is not a valid excuse to say you are "too busy" to make a complaint alone.
  • Well, it is a valid excuse, I am too busy and have no real spare time at all, but, like I said, I haven't asked for any self-righteous bile, just a bit of guidance to the question I asked.

The ironic thing is that you claim to be "too busy" to complain, but the time you've spent posting (often in duplicate) on this forum tonight would have been more than enough to have written a complaint.:)
  • Haha I make you right there, but we are talking maybe 3-4months ago, so it's a mute point that I have five spare minutes today.

I do wonder (as a lesson for any other prospective complainers) if you added up your time spent getting all the details needed for the FOS form which they then filled in and posted off for you (vs you filling it in yourself), how much time did you really save (if any?)

Sam Vimes' Boots Theory of Socioeconomic Unfairness:

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

  • Chris, there are a couple of different things you can do from here.

Speak to SF and explain that they have not carried out their service as described to handle your complaint from start to finish and ask for a discount on their fee, you have a contract so it would be entirely discretionary but some other posters have tried this in similar circumstances and at least received an offer of a reduced bill. Bear in mind that they don't really want to spend the time involved in civil proceedings.

Make a formal complaint to Halifax about the way they handled your complaint as they have ignored your written instructions and authority to deal with SF on your behalf meaning that they negated the contractual agreement leading to you having to spend time etc dealing with it. Ask them to pay SF to resolve this matter as they appear to be in breach of FCA rules on complaint handling.

If you have time of course, if not then pay the bill and move on.

Ignore all the judgemental lectures and criticism on here
  • Thanks AVB, that's good advice, thanks very much.

Typical clients trying to get out of paying fee's. Halifax have no right telling you to deal with them solely, so if SF did work and inquire to halifax then you will have to pay the Fee and rightly so.

They would Halifax tell SF that when if we they did no work on the claims????
