  • POPLA - parking on private land appeals.

    its an independant organisation, when you recieve a rejection letter from your original appeal it should contain a popla code to use for your popla appeal.

    as for the appeal itself im also a newbie and havnt had to do one as yet...

    Hope everyone is well. Ive recieved the following letter / reply from CPlus


    Dear Sir,

    Thank you for your correspondence concerning your Charge Notice.

    This PCN was issued legally and correctly according to the BritishParking Association Approved Operators Scheme.

    Given that the signage is displayed in compliance with all relevant lawsand regulations, the fact that you were seemingly unaware of this is notconsidered a mitigating circumstance for appeal.

    We have noted that you have sent us a template letter.

    In light of this, on this occasion, your representations have beencarefully considered and rejected.

    We can confirm that we will hold the charge at the current rate of £100for a further 14 days from the date of this correspondence, after which thefull amount will be due.

    Although we have now rejected your appeal, you may still haverecourse to appeal to Parking On Private Land Appeals (POPLA), an independentappeals service. To appeal to POPLA, please go to their website and follow the instructions.     They made reference to how I used a template letter ? Any issues around that ?? So, i now take the POLA code and ?
    What should I do now guys ? Im worried that if I use the POLA template they will refuse that too.

    So what if you used a template letter - so do they! So now just revisit the Newbies thread to find the CP Plus POPLA template and copy & paste it into word, amending any detail not quite right (if any). Then post the draft here for comments.

    When up against a forum-based appeal, I think CP Plus won once or twice at POPLA but normally lose on GPEOL (explained in the NEWBIES Thread).

    You say you 'met a friend who's child is disabled' which if this was a normal/reasonable firm, would mean you could have asked for a reasonable adjustment of time allowing for the difficulties faced by carers in a group with a disabled child. But neither POPLA nor CP Plus will care about that law (the Equality Act 2010). However the Motorway Services should care. Have you complained to them in writing yet or phoned up the site Manager (not the first person who answers the phone!) & explained you were with a disabled child which under the Equality Act requires a reasonable adjustment of time restriction?

    Try the complaint, really assertively to the CEO of MOTO or whoever it was, in tandem with the POPLA appeal.

    Hope everyone is well, perhaps watching Children in Need. An excellent cause. Ive promised to donate £15 to CIN if I can put an end to my parking woes :-)


    So, copied the template letter and adjusted dates / names etc. Who do I send it too ?? Do I just email CPLUS again, or do I now send it somewhere else ?? Can I email or should I send a hard copy ?


    Due to character limitations on this reply, Ive just copied the beginning / end bits as these are the only bits Ive adjusted.

    As the registered keeper of the vehicle, registration number SN 04 BCB, I wish to appeal against the parking charge issued by CP Plus Limited on the following
    5 points :-










    1. The charge is not a genuine pre-estimate of loss.


    2. No standing/authority to form contracts with motorists



    3. Failure to invoke Keeper Liability under the Protection of Freedoms Act 2012 (the POFA).



    4. Unclear and non-compliant signage created no contract with the driver.



    5. The ANPR records are unreliable, non-compliant and not proof of one parking event.






    TEMPLATE



    Based on the above arguments, I therefore respectfully request that my appeal is upheld and the charge dismissed.

    POPLA adjudication is binding on the PPC, not the motorist.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Hope everyone is enjoying the weekend.


    So, still a little confused. If POPLA come back and say that my ticket is fair, do I still have to pay ? Searching this site a few people just say to ignore it as they cant do anything, ignore letters, threats , etc.


    Evidence pack ?? What do you mean ? POPLA will email me and give it too me ? I can give credit card statements to prove purchases in Costa at the time. That's pretty much all I can give. I say me, but it was my wife that was driving. Like most of us I was at work and have been given this pleasure to sort out :-)


    I haven't received any other letters yet but I reckon I will. I emailed in my first appeal and they replied with an email.

    Why don't you start learning how to search this forum? You would be soooo much better prepared and informed. Put 'evidence pack' into 'search this forum' which is a heading next to 'forum tools' immediately above the sticky threads on the right. Change the default search to 'show POSTS' instead of threads. Read about evidence packs and how to rebut them. Of course the evidence does NOT come from POPLA, think about it...you have appealed so who is going to have to show some evidence back to you and POPLA? Why not just read the POPLA website a bit to learn what happens, as there is a summary for appellants to read.

    Thought I would update everyone. So after being told off by couponmad user about not reading the sticky bits etc etc, I decided to email the CEO of Costa ( Whitebreads ) and Moto. I looked up their email addresses on google. I didn't go in heavy i.e. shouting / screaming, infact I titled the email "Hello and goodbye". I mentioned that I'm a loyal customer and always use Costa but now I've been charged £50/100 for using their establishment then that's me done and good bye. Whether 1/2/3 hours, I was in their shop buying goodies eating / drinking with small kids etc.


    Well, got a reply from the CIO of Whitbreads saying he would investigate and then got a reply from Moto CEO cancelling my ticket. Infact on my initial reply to the Costa CEO thanking him for his reply, I attached an email with a picture of me at Costa, in a team meeting, showing him that I meant what I said, that I was a loyal Costa user.


    So, ticket has been cancelled. :-)


    Like to thank you for your help. I know you guys keep saying to read the sticky bits but sometimes there is so much information there it's hard to take it all in. I appriecate that you must get fed up of the same questions from newbies but being all moody about `read the sticky bits` doesn't actually help and makes you scared to ask.


    Anyway, ticket cancelled and that was due to your help, so I have now donated £15 to children in need as promised.
