Personally I would write to the lenders and send them a copy of their signature, birth certificate and council tax bill then see what they say.

Since you're not the person in question, they wouldn't be able to send you copies of the agreement.

I wouldn't do any face to face talking with them and i would get it sent from him and they can speak to him. Without getting hold of their birth cert as well would it work as all it says is where you were born not where you live now. CT bill DL etc can be sent off as thats good proof so may send them in with the letters.

Surely this comes under the remit of the ICO http://ico.org.uk/concerns
Send all 3 reference agencies a LETTER headed COMPLAINT telling them to remove the incorrect information or you will take the matter to the ICO.
  • I sent a letter off to Call Credit re the ICO issues and all they came back with was to contact the companies which put the data on as they can't remove them.

I guess I will send the other two agencies this letter and then submit all to the ICO as well as deal with the ombudsman for the companies that are playing hardball.

I remember watching something like this on dispatches and thinking surely it can't be that hard. Now I am helping someone in the same boat I know know how bad it really is

The CRAs are the ones holding incorrect information about you, they are the ones in breach of principle 4 of the DPA and should correct it.

Ah, but if you can send the companies a copy of BOTH birth certificates you can prove that there are two different people. This might make them consider things more carefully rather than just dismissing you as someone who is trying it on. You could even send them documents to prove your recent history of addresses, which wouldn't match their records.
Changing the world, one sarcastic comment at a time.
  • Cheers guys. I will get this sorted out this evening. A fun filled evening for us (well him as I did all the legwork so he can do all the letters etc night) in from of a bottle of wine!

    Much love
