Call any car dealers

Can you let me know what costs you would incur if someone cancelled an order for a new car, if delivery of that car was about 5 weeks away.

  • You'll be governed by the dealerships own cancellation policy at the time you ordered...as your order formed a contract.

    Generally if it's a standard car in a decent colour with no extras they may be able to sell it on quickly. If you've ordered extras they may charge you for those as it makes the car harder for them to sell before it starts incurring a debt for them once they've been direct-debited by the manuf'r for it.

    If it's been factory rodered for you and is only 5 weeks away it will be too late for the dealer to cancel it at the factory so he'll be stuck with it.

    What's the make/model/spec?

    ..and go and check the dealers own paperwork and canxn policy....

    Having recently cancelled an order for a second hand car through a deal I would definitely read the cancellation policy... I'm getting my full deposit back as the dealer had not yet incurred any costs so check with the dealership and ask them outright if the car has begun being manufactured. If it hasn't then you shouldn't really incur any costs I'd have thought, if it HAS started being built then I guess as DealDrivers says it will depend on if they can easily shift it or not - if it's a desirable car then they might not mind too much - ie a mate fo mine whent he mini Cooper S came out bought a car someone else had ordered and specced up but as he couldn't complete the purchase he was intending the dealer ship offered it to my mate with a VERY slight reduction in price but as there was a waiting list at the time he got the car instantly and didn't have to wait for one with near identical spec to be built... The dealership didn't loose any money... :) So guess it all depends!

    It is likely though, that they will just turn around and say yes surely?

    I'd check your contract carefully, and take it from there. Let us know how you get on...

    I know nissan take a deposit at time of ordering of £200 if you do not go ahead with purchasing you forfeit the £200. covers their costs apparently.

    The only way to find out for sure is to ask the company you have ordered it from,i dont know why you want to cancell but if it is because you are getting a better deal elsewhere, don't tell them,give them a sob story instead!!

    Thanks guys for the responses.

    It's a friend that is cancelling (honest!) and she paid the deposit over the phone and has not signed anything - the order was placed verbally.

    The colour is one of the freebie colours in the range and the only extra she asked for was parking sensors which she understood to be dealer fitted anyway.

    The salesman she has been dealing with said she could have her deposit back once the car had been sold as they (the dealers) had bought the car so at the mo were losing out themselves, but as I said to her what guarantee does she have that they would be telling her the truth about the position of the car?

    Are they telling her the truth about this?

    (btw it's a VW Fox she was going to buy but due to a change in circumstances can no longer go through with the deal)

  • Your previous post said the car was still 5 weeks away. If that was true then the dealer won't yet have paid for the car. They will be direct-debited by the manufacturer on the 4th week after it arrives in stock...so they still have 8-9 weeks before they incur a daily interest debt on the car if your estimate of delivery was correct.

    However, there are quite a few Foxes in UK stock now and not a great rush of customers so they may have a problem moving it on as quickly as they need to, and they are perfectly within their rights to hold her deposit. If they cannot move it on by the 4th week after it arrives into stock then yes, she has cost them money as they'll have to pay VW by then.

    She needs to be clear with them about cancelling as the dealer can then place it on 'free release' so other VW dealers can see it on the national stock system and take it if they have a customer elsewhere for it.

    The rear park sensors are dealer fit so they can at least not put that item on the car.

    They have her deposit and she has still entered into a contract to purchase it...she doesn't need to have signed anything. They would have sent her a written confirmation of her order and deposit.

    Slightly detracting, but some people think that because nothing has been signed, a contract may not be in place. As DealDrivers said, verbal contracts can be legally binding so long as certain conditions are met.

    If a credit facility was part of the purchase then the call would unlikely form a verbal contract. However if it does not and a deposit was paid, a particular vehicle and price agreed (the important parts of the contract), if a dispute arose, a judge could well rule that a contract is in place.

    Sounds to me as though the dealer is being fair. Some would just have told her that the deposit was non refundable and thats that. At the end of the day a deposit is a sign of your intention to complete the deal - if deposits were refundable than what would be the point in taking one?

    Thank you once again guys.

    I think I will advise her to write a letter confirming that she no longer wants the car, and asking the dealer to confirm that a) it is on the free release register and that b) once the car is sold her deposit will be returned.

    I think she agrees deep down that the dealer is being fair in offering her the deposit once it has been sold; she has been advised to check every so often what the situation is but she doesn't know whether he will tell her the truth or not.
