Who do i pay? Monument raphael mackenzie hall....

SORRY IF THIS IS LONG-WINDED!!
Sometime ago my husband made a payment arrangement with Monument to clear the balance on his credit card after he suffered a serious accident. After a while Monument, I believe was taken over by Compucredit (who I believe is an American company) but shortly after that the debt was handled by MacKenzie Hall.
Everything has been running smoothly with MacKenzie Hall for a number of years until recently. MacKenzie Hall offered a discount in 2010 if my husband increased the monthly payments, he agreed and continued paying the increased amount. At regular intervals my husband asked the question, "How does the discount get applied to the account?", everytime it was ignored.
The crucial time was coming for the account to be almost clear (minus the discounted amount) - the question about the discount was asked again - this time MacKenzie Hall gave various responses, all of which didn't correspond with the evidence shown online. MacKenzie Hall obviously didn't want to pay the discount.
My husband has sent a complaint to the FOS and they finally forced MacKenzie Hall to offer the discount - however, it was the condition that my husband's credit record would be marked as "partially satisfied"!!! He was not happy with this since it was a little over £100 discount. My husband finally decided to go further with the FOS and he is now awaiting an adjudicator to look at the case. All payments to MacKenzie Hall were suspended upon the instigation of the complaint/case.
Now the big issue is, Monument have sent my husband a pending default notice if the arrears are not paid by the 10th of November.
I've written to Monument to explain - no reply received.

I've emailed the FOS and they cannot provide any details until an adjudicator has looked at the case.

Rung Monument today and they say - "speak to MacKenzie Hall" (who incidently have closed my husband's online account),

Spoke to MacKenzie Hall - they say "Speak to Compucredit", spoke to Raphael & Sons (the UK side of Compucredit) and no one answers!!!

If anyone has any idea what to do please could you give me some advise because my husband does not want a default on his credit history. (and I apologise for the waffling!!)

What shows on your husband's credit history currently in relation to this debt?

I would be very surprised if he hasn't already had a default for this debt at some point in the past (if that was in the last 6years it would still show on his file, if more than 6years ago then it will have already dropped off).

They are not allowed to add a new default to his credit file that, from the sounds of it was defaulted many years previously.

  • Thanks for your reply.

My husband has never received an "official" default in writing for this account.

Should I just pay Monument who regularly send statements which have bank details on the back? Would this hold wait if he is defaulted and we try to get it over-turned?

    At a loss......

  • Crikey. The account was opened in 2000(?) at a guess. He had his major accident in 2004, so probably sometime in 2005. He made a reviewable arrangement with Monument for them to suspend interest for a period of time. Then I think when they were bought out by Compucredit they more or less passed it straight to MacKenzie Hall to deal with.
Everything was running smoothly until we suspended payments for the FOS complaint - which has provided more headache really.
The arrears are £77 which is needed to be paid to stop the default notice going thorough and the overall balance is £255 (excluding their so-called discount offer).
