£5 a month BTL/Virgin Xbox live???

Hi guys,

Many many years ago I think NTL told my dad that in order to play the xbox online we needed to pay £5 a month. It turns out my dad has continued to pay this for approx ten years now.

However I know this £5 fee is not required, especially as I used to rent a property that had virgin net and the console just connected normally.

I feel like this has been missold and that the £5 a month has actually been paying for nothing as it isn't required.

Do I have any grounds here in looking to claim this money back? It could be as much as £700ish.

Doing some research it seems they introduced this back in 2003 when it was not possible to play the xbox and at the same time use a PC, http://www.eurogamer.net/articles/article_47262. Now, clearly this is no longer the case even if it was back then in which case they have been charging my dad for something that is plain pointless.

PS, I know my dad should have monitored this but it isn't his area of expertise.
